It is quite ridiculous that they ask for a second medical when form i-485 clearly states that a K-1 visa holder is not required to complete a medical if a previous medical was completed within one year. In hindsight it could be that the medical was not completed correctly for the initial k visa, even though it passed the requirements of a k-1.

It really does make me mad to hear stuff like this happen to people filing AOS though, considering how much money we are all paying to process the visas. To add salt on the wound, you have other people who are in the US illegally yet are complaining that they should be provided with platinum service immigration and rights..

Same thing happened to me, they sent a RFE for medical that I did already within that year. We called uscis info line and they told us we shouldn't worry about it and we should just send the vaccinations. So we sent the vaccinations, and they denied my AOS :wacko:

I really find it hard to understand how these sorts of mistakes are made by USCIS. Do they not know their own policies? Christ, nearly everyone here on VJ knows the rules about the medical and vaccination supplement for K1s by now.

I hate hearing things like this. Does anyone have any idea why they would ask for a new medical, if the old one hasn't expired? Is it possible the Dr. didn't date the form, forgot to sign, missed a box, etc. I have no idea, but that makes me sick when they do things like that to people. It cost a lot of money to bring your loved ones over to the US. I think they should assign your case to one person in the us and one person from the country you are migrating from, from the beginning to the end (is there an end by the way). That way this person in the US, can look at your case from beginning to end, and see your progress from 129, 130, 485, EAD, etc, etc.

If they deny your case because of the medical, which clearly passed at the K process, why would they deny without appeal in the AOS stage? This doesn't make since, and I hope someone can post a good reason for them doing this.

This makes me soooo mad, she tried to explain and she gets a denial - when she hasn't done anything wrong!!! :angry::angry: Why should we pay again for a medical inside a year!

Useless mother fcukers is all I have to say about them!

If this happens to me I will call my senator (who hubby knows) and complain to Laura Bush, things seem to happen when you write to her.

My friend who was denied had her infopass appointment the other day and she was terrified they were going to cart her off to jail or deport her on the spot or something, but they said not to worry - she just has to get the medical done and apply for AOS all over again! Which isn't as bad as it could be... but it must suck to have to pay all those fees and to start from square one when you've already been waiting so long that your daughter (who wasn't even conceived when you applied in the first place) is now one!

I agree with you 100%. This is something that happens quite often here. I just don't understand. The government is calling for " immigration reform ", but I hear nothing about reforming the USCIS with standard policies that everyone can follow for an easy journey. This whole second medical examination is bizarre. It is also bizarre that fingerprints expire after a certain period of time, and it is bizarre that you have to fill out 8 pages of G325 information which is exactly 8 pages of the same information.

These guys are idiots, and they are responsible for our national security.

Because immigration reform in this country isn't about border security, or streamlining processes... it's about being politically correct, and getting votes. Period.

Well now I am fearful - we just sent off our AOS last Thursday, I find the whole immigration process a nightmare Ridiculous! to request another medical in full when the k-1 medical is valid for a year. I hope and pray I dont have to get another one - I find America so expensive! I just told my husband we would be better of in the UK - at least the process isnt half as bad there!!

Heres to a speedy positive AOS result for us - or does that depend upon whether the person looking at it has had their dunkin do-nuts ???? if I get an RFE !

Sigh....I was just questioning this a week or so ago. I received some assuring answers but now I am not so sure. It's scary that the local office has this much power, y'know? I mean, we're prepared to do another medical if we have to...I'm almost to the point of calling the local office (when we get ready to file AOS) and ask if they require a new medical, even if the one he has is good for a whole year. I know we have to get the vaccination supplement. I hope you get things worked out.

Sigh....If it isn't one thing, it's another in this LONG journey.... :blink:

I feel for the OP. (F)

Looks like yet another example of the relevant paperwork getting lost somewhere in the system (I use the word loosely here!) and the applicant suffering the consequences. How often do USCIS admit there's been an error at their end? Hardly ever - Who needs to do that when you can simply hide away in your impenetrable grey fortress, fling out an RFE and sit back while the poor applicant concerned scrambles around wasting yet more worry and/or heartache, time and/or money re-doing unnecessary stuff. :ranting:

I really hope you can sort this horrid situation out. I do hope you did go along to the biometrics ... it would be such a shame if you missed that appointment and then manage to get your case re-opened ... and it shows you're determined to try to go through with everything. Plus you had already paid for it! Did you go???

Do also try the Infopass thing as soon as you can, won't you. Hopefully you'll get someone who is prepared to use their common sense and is prepared to do the right thing here ... It is possible. Having ranted about the all too evident uncaring, thoughtless morons, I must admit I have come across one immigration officer who's prepared to do more than the minimum ...

Somehow or other we forgot to take Kyle's divorce paperwork to our AOS interview in Dallas in late December, so the officer asked for copies to be returned to him. (I'd better not start on about why you're expected to repeat all the stuff you already did for the visa application ... Anyway...) We sent off the requested papers on New Year's Day and waited. We didn't hear any more 'til early Feb. The biometrics thing went ahead then so I assumed all was well.

March arrived and I received a telephone call from another guy from the Dallas AOS Dept asking where the divorce copies were because that was all he needed to complete and approve my application! :blink: When I said we had sent them months ago he said that lots of things go astray and asked if I would be able to bring another set, addressed for his attention, and hand them in to the entrance security so that he would be sure to get them that way. Needless to say I agreed to do that and we arranged that I would drop them off at lunchtime the next day. When I handed the envelope over, the security guards said the officer had already been out to check once and they would let him know the stuff was waiting for him. My approval followed shortly afterwards! Yippee!

So, my experience shows that there is at least one guy in the system who actually seems to give a damn, uses his common sense and is prepared to get off his ####### when needed ... Mind you, he might just like keeping things moving off his desk ... :whistle: I don't think so though, when I was talking to him I actually got the feeling he was interested in helping. :thumbs:
