Timeline

uscis asked medical( my k1 medical was last octobor) and i864 again, i wrote a letter and explained i had medical a few months ago for the visa, and i will send them when i file tax return 2005, a few days later i got denied letter, and it says NO APPEAL.

i have appointment this saturday for fingerprint, but now what can i do? sooooo sad.

It seems you took things a little too casually! The only thing I can think of is to make an infopass appointment and see if they will accept a medical and an I864. Most people on this forum tend to comply with the wishes of the USCIS - Even though the medical request is incorrect - they have insisted on it in the past so no use fighting it - just pay the bucks and get on with it. If your infopass is fruitless - then you may have to refile (might even have to go back to Canada and file for a K3.) Good Luck

they asked both, i just explained, and asked them if they have any question please let me know,,it is still within the due date,,( another 2 months)and could you tell me what the infopass is about? how to do that? is it possible that will make my case worse? my lawyer suggest me to refile.

Same thing happened to me, they sent a RFE for medical that I did already within that year. We called uscis info line and they told us we shouldn't worry about it and we should just send the vaccinations. So we sent the vaccinations, and they denied my AOS :wacko:

You should go for an infopass appointment and ask them for help. There's two things you can do from now, either reapply for AOS all over again, or you can file a motion to reopen the old case. In any case you would have to do the medical, and it takes time to get the results from the blood tests, so it's better to get the medical done (by a civil surgeon from uscis list) as soon as you can. Hopefully if you go for an infopass appointment they will explain your options to you and you can decide what to do next.

So, I went and re-did the medical and vaccination supplement and sent it along with a letter of explanation.

Best thing you can do now is follow the advice other posters have given re infopass and either new application or motion to re-open old one.

When I phoned the information line they were in agreement that according to their own rules he did not need another medical (they were asking for a full medical which had been done 9 months previously and vaccination supplement which was already sent with the original AOS package).

However, I was also told that if the local office asked for it then I had to comply regardless of what the writen rules say - it is their perogative to ask for anything they want and if I didn't produce it within the timescale my application would be denied, no matter how much of an explanation I gave.

So, I went and re-did the medical and vaccination supplement and sent it along with a letter of explanation.

Best thing you can do now is follow the advice other posters have given re infopass and either new application or motion to re-open old one.

Hope it all works out ok for you.

I agree with you 100%. This is something that happens quite often here. I just don't understand. The government is calling for " immigration reform ", but I hear nothing about reforming the USCIS with standard policies that everyone can follow for an easy journey. This whole second medical examination is bizarre. It is also bizarre that fingerprints expire after a certain period of time, and it is bizarre that you have to fill out 8 pages of G325 information which is exactly 8 pages of the same information.

These guys are idiots, and they are responsible for our national security.

Somebody needs to make a big bold pinned warning post about medicals... this is happening over and over again lately - somebody gets asked for a new medical and if they get it they're approved, but if they don't because they think their old one should still be okay they're denied :(

I hope you can do something about this... you're the fourth person I've heard of this year who got a denial for non-providance of a new medical, and many more people have had to repeat them...
