My wife was planning to file an I-90 to get an error on her green card corrected. Then she lost her wallet yesterday and her new green card was in it.

Can we still file for the no fee I-90 or will be have to file it as a lost green card? If we file as a lost green card, how do we ensure the mistake gets fixed as well?

Thanks. I knew we're supposed to file I-90, but am not sure which reason to put on the form. The card was incorrect and lost. Do I mark both reasons down?

You still have to go through the same prosses to get your new card. Just file I-90 form.

Also tell your wife NOT to carry a green card on her. There is no need to. All she needs to do is to get her ID at the local DMV office and carry it with her instead of GC.

I know we need to file I-90. What we're trying to avoid is having a new card issued with the same incorrect information on it (inccorect category code). So which reason do I check on the form? That the card was lost? That is was issued with incorrect information, or both? We have to send the application to a different location and include different evidence depending on the reason we select.

My wife had just gotten her card and hadn't had a chance to photocopy it yet (she carried a photocopy of her previous one. She was going to have it copied the day her wallet went missing. It was just her lucky day I guess.

I was doing some searching on the USCIS site and found this:

Section 264 of the Immigration and Nationality Act provides that, "Every alien in the United States … shall be issued a certificate of alien registration or an alien registration receipt card in such form and manner and at such time as shall be prescribed under regulations...." It also states, "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him.... Any alien who fails to comply with [these] provisions shall be guilty of a misdemeanor" and may be subject to fine and/or imprisonment upon each conviction.

So, as much as I don't like the idea of having her carry her green card on her, the law seems pretty clear about it. I'm not sure whether a photocopy would suffice or not.

We went ahead and filed an I-90 citing option 'd' for an incorrect card. We submitted evidence of the error and the correction needed. We then included a letter requesting a waiver of the requirement to return the original card because it was lost/stolen. We also included the mailer the card came in.

I figure it's worth a shot. The worst they can do is reject the application and send it back. We'd just be out the money for postage. The error isn't just on the card, it must be in their system since her conditional card had a similar error on it. Perhaps what we sent will be enough to get it fixed.

Right! The alien has a requirement to carry the GC with at all times. I've often wondered where one puts the card if at the beach, but I digress. I'd recommend that any green card be photocopied, and that copy be placed in a safe place, so that in the event that a card is stolen or lost, at the very least the alien can show the copy of the card as it was.
