Hi

I need to know if disability social security income qualifies as being able to sponsor my fiancee on a k-1 visa.

Along with my aunts income(I live with her) we have a total of way more than the 125% required to sponsor him. Also since i don't file an income tax return(ss disability not taxable amount) what do i need to get from the IRS to substantiate this?

Please if anyone can advise me i will be forever thankful.

To my knowledge yes you can use the disability. Just remember that it is not combined income that is used to qualify. Does your aunts income meet the poverty guidelines on its own? As for not having to file tax return, go to the INS site and get a copy of the section that applies to your excludibility and include that with your AOS form. If I'm not entirely correct on this I am sure someone will correct it.

Am I losing it or what :unsure: I was under the impression that one only uses combined income when filing both an I-864 and I-864A, otherwise for an I-134 a sponsor must show they meet the poverty guideline on their own. Perhaps I shouldn't answer anything more until my head is in a better place. I dont want to be steering anyone wrong.

The issue of a sponsor meeting the poverty guideline on their own (actually the sponsor's household, including willing Household Members) is an I-864 issue. Non-immigrant visa financial requirements, including I-134, make no mention of it.

So, my response to your post was not really appropriate.

Yes you can use disability income... my husband recieves disability and we used it when we filed for AOS.... as for not having to file tax returns... on this I am confused.. as I said my husband gets SSI and he still has to file a tax return showing that his SSI is his only income and we had to include it in this years joint tax return..... you maybe want to check this out....
