aloha,

she came to usa on k-1 fiance visa, we married here in the states.

just before the change of status interview, personal family matters required her immediate return to her home country - application abandoned!! sighhh!

so what is the path we take now? is K-3? is it IR-1? CR-1?

are we in the right discussion forum??

please help us.

SORRY FOR THE CONFUSION - after my wife made it to the USA, family emergency neccesatated her immediate return to her home in cambodia. unfortunately before she was able to adjust her status, thus the case was abandanded. we now are filing both k-3 (married in usa) and have petioned both i-129f and 1-130 .....so, our "journey" has once again began. thank you for all your help and understanding - appleegg and sreyon.

HI.

we're both in a same situation..used k1/k2 visa, then got married in US, then started filing the AOS, but family problems in Phlippines, so have to go back and cancelled the AOS, and now, starting all over again but on Cr1 route.

im not sure of the complications, but we taking the risk though.,

hope anybody here can enlighten us..

I would suggest going the CR1 route. She can't reschedule an interview because she has no valid visa with which to return to the USA. (The OP knows this but a couple responces, seemed not to realize this little difficulty.)

Nobody has mentioned anything about advance parole so the assumption is that the alien spouse did not receive this before departure? I also realize if the I-485 has in fact been terminated/denied then that benefit ended at that time as well...

He said the beneficiary left the US right before the interview so the AOS was abandoned. Whether it was due to not having AP or missing the interview, the result is the same.
