Today I received a letter from the Charlotte sub office about the latest result regarding my wife's greencard interview. The bulk of the letter says...

The processing of your case has been delayed. A check of our records establishes that your case is not ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact the misinformation center.

Well there you have it... God knows how long we would have to wait for the results. I just thought that I would share this with you... I guess at this point there is nothing I can do... If so, please let me know. Thank you and take care everyone.

Sorry to hear about the delay in your case. At least you heard from them and know they are definitely working on your case. It's just a matter of time, and you'll get the Green Card.

Thank you Raymaga. Actually I would not have received this letter had I not called the 1800 number to do an inquiry... 2 months had passed since my wife had her greencard interview... Anyways, I guess we just have to wait.

Thanks everyone for your comments. What I want to know is based on the letter they are doing background check on my wife. Is this different than the fbi clearance check? Is this the same as police clearance that I had to gather from the courthouse which the immigration officer never bothered to take from me?

I think it's the black hole of immigration otherwise knows as the FBI name check. Interesting that you received a response after calling the misinformation line. I called them 6 months after Carina's interview and was told I just had to wait since Chicago is still processing applications as of November 2004 and we applied December 2004. The fact thas Carina was approved pending the name check at her interview in October 2005 or that FBI told us her biometrics were never received didn't seem to disturb her at all. I sent a status inquiry letter to Chicago on 2/1/06 and haven't heard word one.

I am thinking we are going to get an answer much like yours when we go to the InfoPass on Thursday. If that happens then I call the misinformation line and request a referral once they are processing December 2004 and contacting the USCIS Ombudsman.

Thank you DCL766. I am just frustrated at this point... My wife has applied for grad school in Charlotte for the fall semester... She is considered an international student until she gets her green card... Also there is the residency issue in hand. Although she has been in NC for more than a year, there is a chance that she may not qualify for in state tuition... Not to mention that I have my very last final exam in grad school tomorrow, and on top of that we are going back to Iran for my brother-in-law's wedding in about 2 months.

Lots of things are happening and I was hoping that the GC issue would have resolved by now. I hope you get good news soon.
