I need some advice...

Timeline

Hello all,

I am just getting ready for my interview next month.... and then finally I can go to the states to be with my boyfriend!!

But the thing is we got some problem. My boy is in the military and he is in hawaii right now. Once I get a visa, I go to hawaii to be with him( I plan to go there at the end of April right now) He has to move to a next place in Jul. So, we are planning to get married in Jul, in his hometown(not hawaii), before he moves to a next place. But he just found out that he has to go to Korea... And he told me that I cant go there with him. Plus once I get married, then I have to apply for GC and evrything. And while I am applying for it, I cant leave the states without Advance Parole... right?

So right now I just dont know.... I am not sure how long it is gonna take to get GC or Advance Parole.... So I just have to be in the states by myself, to wait to recieve them. I am so worried.... If he is in Korea, then it is a lot closer that I stay in Japan, you know. I am gonna apply for GC and Advance Parole soon after I get married, but how long does it take usually?

I have been patiently waiting to get K1 after all these months, and now we have to be apart again? That is just not what I expected... you know.

I just dont know what I can do about this..... :( Hopefully I am making sence....:( I am so shocked right now...:(

Could you move the wedding date forward? He could ask for a few days leave to return to his hometown for the wedding and then you could file the paperwork much earlier and hopefully receive AP in time to move with him, or at least follow shortly after.

Tell him to speak with someone in the legal office on base. They are there to give advice to military members and this situation comes up quite frequently. There have been many in your situation...don't worry, they should be able to help :)

K-1 Timeline:

May 31, 2007 - Mailed I-129F to Nebraska

Oct. 22, 2007 - NOA2 Hard Copy received!! No email/website update.

Nov. 16, 2007 - Paperwork found & received by NVC!

Jan. 7, 2008 - Finally got the interview date

Jan. 28, 2008 - Interview!! Approved!!!

Feb. 12, 2008 - Arrives in USA!!!

Feb. 18, 2008 - Wedding Day!!!!!!

Feb. 19, 2008 - Apply for SSN

AOS Timeline:

Mar. 12, 2008 - Packet mailed (AOS, EAD, & AP)

Mar. 12, 2008 - Husband's SSN arrives

Mar. 14, 2008 - AOS pkt was delivered at 7:52 AM & signed for by V BUSTAMANTE.

Mar. 18, 2008 - Check cashed!!

Mar. 21, 2008 - NOA's for AOS, EAD & I-131!! (Dated 3-18-08)

Mar. 31, 2008 - Can finally see AP & EAD online!!

Apr. 10, 2008 - Biometrics finished! Can finally see AOS online & EAD touch!

May 12, 2008 - Email: AP approved!!

May 14, 2008 - Email: EAD approved!!

May 16, 2008 - EAD card & AP in hand!!

Sept 19, 2008 - Interview letter - Oct. 24th - Seattle??

Oct. 21, 2008 - A Touch..WOW!! The interviewer must've put it on his/her desk!

Oct. 24, 2008 - Interview..now back to waiting!

Nov 13, 2008 - Approved! Card Production Ordered...finally!!

Nov 24, 2008 - Card arrives!!!!

I'd suggest getting married before his deployment to Korea. You should get AP within 3 months and would then be able to travel abroad. The green card will take longer (possibly much longer).

Love timeline:

??? 2003 -------> Started chatting regularly, became good friends

Nov 2004 -------> Fell in love

Jan 2006 -------> Met (in person) for first time

Apr 2008 -------> Wedding

Jun 2008 -------> Closed on house together

K-1 timeline:

Jun 11, 2007 -------> I-129f sent

Mar 20, 2008 -------> Visa in hand

AoS/EAD/AP timeline:

Apr 26, 2008 -------> Wedding

Apr 28, 2008 -------> Filed (forms mailed)

Apr 30, 2008 -------> Forms received by USCIS

May 06, 2008 -------> Cashed check posted to account

May 10, 2008 -------> NOA1 received for EAD, AP, and AoS

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

If Im not mistaken, you may be eligible for emergency AP in such a case. Those in the military sometimes qualify for the fast lane in some cases. Have your fiance consult legal advice on his base and/or his superiors. Unfortunately, I dont think you'd be able to stay in Japan to be closer to Korea. Once your visa is issued, you have six months to travel to the US before it expires and 90 days from entry to marry so you can file for AOS (and the EAD and AP). But again, you guys may be able to get some expedited service because he's in the military. I wish you the best of luck!

Thank you for you guys' advice!!! I feel kind of relieved.... I didnt know we might be able to get some help because he is in the Military.... I am gonna have some talk with him, and hopefully things work out.

But right now, after a wedding I am gonna stay in the states by myself, and patiently wait for my AP.... Seems it doesnt take too long to get AP, so I should be fine.... hopefully....

I appreciate all, I might need some help again though....

I will see what is gonna happen.
