That is a good point and is in the FAQ, ( http://www.visajourney.com/faq/k1k2visa-aos.html#6.1 ) though many have filed the AOS outside the 90 days and have no problems, they do for a few reasons like getting married very close to the 90 day mark and having to wait a few weeks to get the official marriage certificate from their records office.

And technically not when the K-1 expires, the K-1 is voided the moment it is used, the marriage needs to take place before the I-94 expires.

Yes, we see a lot of misconceptions about visa expirations. There are visas that don't expire for 10 years but only allow a 6 month stay in the US. I-94 expirations are what is important once the visa is used. K1 visas "expire" six months after issue but you can enter the US the day before they expire, then wake up in the morning with a dead and expired visa and a very LIVE authorization to remain in the US for 90 days.

Facts are cheap...knowing how to use them is precious...

If I were doing a K-1 I think I would hot tail it to the nearest Court House before they change their mind! Actually, I would probably consider bringing a Priest to the Airport. "May I have your attention please. There will be a wedding in the baggage claim area in 5 minutes. All are invited to attend"!

You would need a marriage license to do that! :P

To add to the question about expiry... Once a K-1 is approved, can you file an EAD and wait until it is approved to enter the US or do you need to be in the country to file it?

ROC Journey:

To add to the question about expiry... Once a K-1 is approved, can you file an EAD and wait until it is approved to enter the US or do you need to be in the country to file it?

I believe you apply for EAD once you are in the US and have activated your K1 -- usually at the same time you apply for AOS.

No you do not have to file for AOS before the K-1 expires. The only condition placed on entry w/ a K-1 visa is that the beneficiary of said visa, marry the petitioner (USC) w/in 90 days of entering the country. Most people hurry and file for AOS before the 90 days, because upon expiration of the I-94 (not expiration of the K-1), the spouse is out of status...which is unsettling for some and not to mention it can cause some difficulty. But there is no requirement to file AOS attached to the K-1. In fact, my husband's K-1 expired October 31, but we didn't file for AOS until Dec. 5th. There is no requirement to file AOS w/in the 90 days.
