This is my first post after having lurked and read as much as I could find. I am just a little confused as to why you would file for a K3 if you have already filed your I-130 for a IR-1/CR-1?? Maybe this is obvious and I am certain I am missing something important. Thanks in advance for any advice.

04/07/2008 - NOA1 received HARDCOPY

05/09/2008 - I130 Touched

05/15/2008 - I130 Touched

05/22/2008 - I130 Touched

05/27/2008 - I130 Approved!!!!!!

I-129 Status

04/21/2008 - I129F sent CSC

05/27/2008 - I129F Approved!!!!!!!

06/28/2008 - Interview completed and approved.

K-3 like K-1 is a NON-Immigrant visa so has less processing at NVC, making it a bit quicker than CR-1, some prefer to pay the higher fees and deal with the hassles of the K-3 for the quicker visa.

K-3 has the added pains of adjustment of status ($1010), not being able to get SSN until either having the green-card or EAD card. EAD takes 90 days or more.

Lately there has been some reporting of USCIS canceling the K-3, if they know that CR-1 is only slightly slower to get than the K-3, I assume that USCIS is trying to avoid additional work associated with K-3 adjustment of status, USCIS is tremendously back-logged right now.

There used to be a reason to file K3. For many, doing so allowed them to be re-united several months sooner. Things are changing. I wouldn't file an I-129F for a spouse now at all but that might change again next month.

I forgot to mention a few other pains of the K-3. Since it can take some time to get SSN, all this time you cannot do things like get a driver's license.

CR-1/IR-1 are true immigrant visa that result in Green-card upon entry.

you are 100% right ..... my friend had a same experience like and you not gonna believe he is waiting for greeen card it's beeen almost 3 years now so k-3 sucks i rather wait for -130.. bye

The answer as to which one is better for you is "it depends". In general, the advise given so far is correct. But in my situation, the K3 made more sense. Looking at the "immigration timelines" above, a typical CR-1/IR-1 through Bangkok has been anywhere from 305 to 327 days (only three in the past two years - one DCF at 88 days). The K3's without an RFE have been 160 to 190 days. So Rin and I went with the K3 as it was 3 to 4 months faster in being together. Also, we had no intention of Rin working once she arrived in the USA, so the EAD/GC timing was not an issue for us. We married in October 2006, she arrived in the USA in April 2007. Since her K-3 visa is valid until April 2009, we are waiting until August/September 2008 to file AOS. Her GC will not be issued until after October 2008 and will be a 10 year GC and not require lifting of conditions as we will have celebrated our 2nd anniversary. The impact of this will be it will delay by a year the filing for naturalization (since we could have filed for her GC a year earlier), and it will require her to have another medical exam (my insurance will cover the cost of the exam).

The questions to ask yourself;

1. What is the additional time apart worth to you and your SO?

2. How important is having a GC? This will impact your SO's ability to get a SSN, to work, to get a DL, etc.

it truely depend on your time,

if you want quicker and spend alot of money on readjust k-3 is the process

but if you want true immigrant than cr-1/ir-1

so it really depend on your time to united with your love one actually
