I'm an American, my wife is from St. Vincent. We failed to submit our I-751 on time, and worked diligently to provide a good reason and the supporting documentation. We sent in our package and it was received on Friday, January 25th.

I checked our bank account online today and saw that the $545 check had been cashed by the Texas Service Center. We are inclined to believe that a receipt of our application is forthcoming, and that they have accepted our reason for filing late.

Given your experience, is this an accurate assumption?

I can't really speak from experience, but it would be really cheeky of them to cash a check if they were going to reject the application. That said, maybe the cashing of checks is done before anything else and they didn't realise you filed late. maybe you should schedule an infopass to make sure.

The fee is a filing fee, not an approval fee. Rejected petitions do not get refunds.

I wasn't asking if a cashed check meant that our petition was approved, I was asking if it meant that we would be getting a receipt. When you submit your I-751 late, you have to provide a reason for why (and documentation). USCIS reserves the right to reject any late submission, so we weren't even sure our paperwork would be received. My question was about whether or not a cashed check meant that they had received our paperwork and would be issuing an I-797.

Turns out, it did. We now have the I-797 and my wife's green card has been extended.

The NOA with the extension just means that they have received the petition. It can't be rejected (denied) or approved until it is adjudicated. I do hope you get approved.

Using proper words, I think we should state that when a check has been cashed, the petition file has been accepted (paperwork is complete and fee is correct). Otherwise, it could have been rejected. If the filing has been accepted, however, it only means the process has just begun and your petition can be, at the end of the road, approved or denied
