:D So far My case is done and I am waiting for the interview letter (IR-1 Canada case). But my husband got a letter from NVC and said there are some missing documents in his I-864 package and let him prepare them and send them to me for the interview. The missing document is the explaination why he didn'f file 2003 tax return. Before, He send NVC the letter 2 times to explain that he has no any income in 2003 so that he didn't file 2003 tax return. Why did they still ask it? Does he have to file late return for 2003 though he had no income?

Another question is that I got my police check in the middle of last Jan. If the police check is valid only for half of year(I got this from the poster of others), Do I need to get one more update police check in advance? (Because according to the Montreal cases' timeline, it seems that I can get interview in Aug.) Or just wait for the asking from Montreal consultate? :D

hi there; i'll try to help: :)

i'm the US citizen; as i have not worked in the US since 1998, i haven't filed taxes in a few years. when i completed the I-864, i wrote a letter stating that i had no US income, thus didn't need to file a return; i also attached a copy of the page on the IRS' web site stating that if you make $X,XXX or less, you don't have to file a return. in the I-864 package, it tells you where to find that info on the IRS site.

i'm under the assumption that the RCMP check is good for a year? i don't have a copy of my husband's check in front of me, but i'm pretty sure it's good for a year, so we're okay. maybe someone else can chime in on this one?

I think the process in my sig will also send you a document from the IRS that says that you didn't file a return for a given tax year, but I'm not sure. I've always had to file a return. :P ttyl,

:D Thank you for the replies. My husband definitely explained that he had no income in 2003 and attached the copy from IRS tax book in the I-864 package. He was still asked to give an explainantion :angry: Anyhow, my husband has filed the 2003 tax though he has no income then.

By the way, why do I have an idea that the police check only is valid in half of year :blush:

I think the police check is only valid for 6 months if you still live in the country that issued it. So you didn't do anything illegal in the meantime.

If you still need roof for non-filing, call the IRS, talk to an operator and request a verification of non-filing. It's an official letter.

Also, attach the 1040 instructions Chart A to your explanation and tell them something like this.

For 2003 my income (single or married, whatever it was) was less than $... and therefore according to the IRS instruction, I was not required to file a return for this year...
