Cancelling I-129F at Embassy-Best Option

Hello,

Months ago I successfully filed a I-129F thanks to all the help from the VJ members here. It made it to the embassy in Kiev, and then due to some unfortunate circumstances based upon my ex-fiancee's dishonesty, I will not be executing the visa. The NOA2 was official on Oct 20, 2007 and if I recall correctly, it has a 120 day validity. I had not done anything official at this point, as to make sure this is what I really wanted/needed to do. It is. So, how should I go about doing this? Notify the embassy before the expiration date? Should I do nothing and let it expire? If I just let it expire, what happens with the petition? Do I need to do anything with USCIS?

Any feedback, pros and con's of one way versus another, etc. would be greatly appreciated. Thanks in advance for all your help.

We have a sort of similar situation about what to do with the expiration of the I-129F since the Egyptian Military enlisted my Husband. I emailed my consulate for immigration and non-immigration. It's been over a week and I'm still waiting for a response. I asked them the same questions you're asking. I also asked on VJ about it but I didn't get any responses either. Good luck! I'm tracking this thread to see if anyone says anything about it.

Hi Krystyna, so very sorry to hear about the dishonesty...but, am glad you found out now, rather than later! I do believe you should contact the Consulate in Kiev: http://kiev.usembassy.gov/visa_contactinfo_eng.html ... good luck to you...

Hi Jen, thanks for the reply. My name is actually Rich, and Krystyna is the name of my now ex-fiancee.

Anyway, yes, contact the Consulate IV unit, informing them you are withdrawing your petition. They'll get back to you if they need anything further. Email or fax is usually most efficient.

So sorry to hear your situation...i would think contacting the consulate by certified receipt to be on safe side - (many will attest to things getting lost) - best wishes
