Hi again, well this issue is about the ssn. After 2 weeks of my arrival here in the US, me and my husband went to the local social security office to get a SSN with the knowledge that K1 can get a ssn. When we got to the clerk/personnel, she told us that im not allowed to get a ssn and i have to go to the Department of Homeland Security for an EAD. Since it takes time for an EAD to be approved, so we're still waiting, and fortunately or unfortunately i found out that thru this site that a K1 visa holder can get a ssn.So dilemna here is that my I-94 stating K1 is gonna expire on may 3. With that in mind, can i get ssn when my ead is approved knowing my visa is K1 when i got here?

The SSA person that you talked with was incorrect. There is plenty of information in their policy documents that clearly states that K-1s can get a social security number. However, now that you are so close to the expiry date of your K-1, you will have to wait for the EAD. As soon as you get it (typically about 90 days after application), you will be able to get an SSN.

They should really send all these people that work in the Social Security office on another training course as so many of them dont have a clue! They were wrong to tell you that a K1 visa holder can not get a SSN as they can. Problem is, you cant get one if your I-94 has 14 days or less until the expiration date so unfortunately you will now have to wait until your EAD comes through.

So dilemna here is that my I-94 stating K1 is gonna expire on may 3. With that in mind, can i get ssn when my ead is approved knowing my visa is K1 when i got here?

Okay, hold up.

You said you went to SSA after two weeks of your arrival.

Then you say that your I-94 states that your K-1 expires on May 3, which can't be right--only your visa will say when your visa expires.

If your I-94 expires on May 3, then SSA was right in denying you a SSN--you'll have to wait for the EAD to come through. But if you did go within 2 weeks of your arrival, and they denied you based on the about-to-expire K-1 visa rather than on the I-94 (which should be valid through June or July, if my math is right), then they made a mistake.

I knew there were something wrong in the process coz i read the regulation about K1 and it says i can get an ssn, but going there and talking to personnel from that office telling us its not allowed, well we have no choice but wait to get married and file the EAD. Oh well damage has been done. I guess for those who are still under k1 should know this, support your document that you could get an ssn you should print this document - its found on government social security website, and search RM00203.500C.1. It will tell those clerks that you are entittled to a ssn.

No, that's not what I asked. Did you go there with two weeks left before the expiration date of your visa or your I-94? Your visa has an expiration date printed on it, which means you must use the visa to enter the States by that date. Your I-94 also has a different expiration date, which is the expiration date of your authorized stay on that visa once you enter the States. Which was it?

Ah, okay.

SSA was wrong, then, in denying you initially. That sucks. :(

But now you have to wait for the EAD, since your I-94 expires in less than 2 weeks.
