We await AOS, but she did get a SS# last year. We await the green card to change her name to her married name, so the SS# is still in her maiden name.

So, doing the taxes, do we use my last name, or her maiden name?

Use married name. Many do even before getting SSN as in K-3 visa holders, they use an ITIN to file jointly and use Married name.

Hello! I think you should use your wife's maiden name when filling tax return specially if you will file it electronically. If you use her married name then it won't jive with her SSN and that will automatically rejected thru electronic file. I remember this thing during my training for a tax preparer... and I got this site for you, please click it so you'll be confident more to file as what it says: (read on #1.10 question)

Did my taxes online (Taxslayer), used her maiden name, and submitted them electronically. Got email the next day that the IRS accepted the return, and it looks like the refund will be in the account on Friday.

So, I guess the advice was correct.

Now if I could just get some movement on the AOS and EAD.....

Yes, def file in whatever name your SSN # is under. I changed my name last friday and tried to efile my taxes the same night and it was rejected. I waited a week, it went through fine. I got my new SSN card in the mail yesterday. If you don't want to efile and you plan on changing your name shortly with SSN, then file in your married name and by the time they get your return and process it, your married name should be updated in the IRS system.
