AOS & EAD Feb. 2008 Filers

Got this email on the third,

The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office.
Not sure if this means Atlanta or what.

I see in your timeline it says your 485 was transferred to California. I also received an email about the standard processing and the case being received. I think it just means they sent it from Chicago to California and it's now at an office there.

Yes that is true, I just looked at my email and it says the same thing. It also says: "Current Status: This case is now pending at the office to which it was transferred." So ashley and jonoz are likely right, good call.

If that's what the email means then they are really slow. It was transfered to the CSC on Feb 27 amd we received the mailed NOA about Mar 3. Seems odd we'd just now be getting the email.

Does it say Current Status: This case is now pending at the office to which it was transferred if it does then I would just chalk it up to a faulty email system. Some people get multiple copies so hopefully yours says this and if so I would not worry to much.

Hey Everyone!

I am new to this forum, but I just want to say what an amazing place!

Anyway, I am the US Citizen and my fiancee is portuguese, and we filed

everything on February 7, 2008 (AOS, AP, EAD, and I-130). She already

was here on a valid F-1, so we didn't go through the whole fiancee visa

process.

I was wondering, if you will note in my signature, since we had an RFE

for the medical exam in early March, and had wrapped everything up

by March 21 getting it all back to the CIS, should this delay the advance

parole? Having read quite a bit on here, I have the impression that an

RFE for medical exam only delays the AOS and EAD, but shouldn't delay

the AP. Is that correct?

Also, based on my signature, should we expect that everything needs to

be transferred to a Service Center before stuff will start getting approved?

I.e., does the NBC approve AP and EAD for applicants like us, or only

at service centers after transfer? Since the nearest office is Detroit,

which service center will our stuff likely get transferred to?

Finally, it is reasonable to expect, based on what is in my signature, that

our advance parole will be approved soon? I have that impression, but

I really have no idea. That is our biggest concern, since we need to have

that by the beginning of June (the earlier the better), since we are traveling

to Portugal for the religious wedding ceremony.

Hi, everyone! I'm new to this forum.

You can see our timeline in my signature. I have been getting increasingly worried because my husband's application still seems to be with the National Benefits Center (we didn't hear about a transfer, and the case numbers are still MSC###), even though he got the EAD card on March 21.

But now that I've looked at the February filer's summary (thanks for putting in all the work to generate the list!), I don't feel so panicky anymore. It looks like most of the cases haven't gotten transferred, and many got the EAD approval without a transfer (like us). There even seems to be two interviews scheduled without transfers.

I wish I found this website earlier. We really didn't know what we were doing, it's a miracle that we haven't gotten any notices for missing documents or erroneous filing (yet).

Hi, I am fairly certain you can actually legally work without the card for 90 days as long as you can show them an approval notice. Check the I-9 Verification Requirements, it says it on there. You have to show approval within 3 days and the actual card within 90 days. The mysteries of immigration!

Yes - THANKS so much for keeping the list AnthonyJulie. It's awesome. I have been feeling really, really sorry for myself the last week b/c I have had no touches since my bio and it seemed like everyone else was getting EAD and AP approval emails....but the once I actually looked at your list I can see that others in the same timeframe as me are in the same boat. So helpful...and calmed me down. THANK YOU for doing such a great job - you're the best!

Thats only for people who have filed for a replacement card.
A k1 visa holder can't work until USCIS has authorized them to work - either via the POE stamp or the EAD card. If you read anywhere that the K1 is "work authorized" then you're reading something from the SSA, not USCIS, and it doesn't count (SSA don't make the decision about whether you can work, just whether you can have an SSN)

read the "Working and travelling prior to getting a green card" forum. This issue is constantly battled.

To add what ashleyandjonoz said, a K-1 visa holder can work too even without EAD or GC as long as the I-94 is not expired yet. That means you can work when you arrived here in the US but only for 3 months..

Btw, our EAD was approved on March 21, not February 13 (that'd be really fast!).

Got another e-mail from CRIS re: EAD saying that they have mailed the new card. :huh: ?!!!? What took them so long to send it!! :angry:
