I originally submitted my I129F that was certified received by CSC on 12/6/07. Now after close to two months, my check has not even been cashed. I called USCIS yesterday, but was told to wait another month. At this point, I have a feeling that CSC had lost my application. Should I resubmit another I129F? Also, I am considering writing to my congressman for help. At this point, I don't want to wait another month to find out that they could not find my original application. What should I do?

Did you verify that you sent it to the correct PO box? CSC has all sorts of PO boxes for various filings. You could try to refile but I would recommend you cancel the first check. If they cash them both you may not get your money back.

HOw did you send it? Do you have signature confirmation?

If you got a signature, then it's there. NOA1 have been taking longer than usual.

Get past the two month period then call in and have them do a service request for you petition (you will have to back date when your petition was sent for them to do this). It took them 45 days to get back to me on my service request. If its lost you will get a letter detailing how to resubmit, they will ask for proof of your previous submission so include a mail receipt or other such item.

I cannot guarantee your 12/6/07 date will be honored as I have still to get my NOA1 for my second petition.

Give it some more time, if you sent it certified you have a record that they have the petition. USCIS is tremendously backed up from the record number of filings last year.

No worries... Takes a while for the NOA1 lately, and they aren't always fast to cash the check, either.

In my case, it took them about 3 months, and I would have never even gotten the NOA1 had I not requested it explicitly 4 months after I filed.

Don't submit another. I'm sure they have it and will get to it.

Lancer, I hope I am not following in your footsteps. Do you mean that I should tell CSC that I submitted my application in November? I read your profile and its scary for me to think that I might waste four or five months and have to resubmit my application. I don't think I can wait over a year for my fiance to get here. Also noticed that we are from the same city, Sacramento. Wish you luck on your second application and let me know how it goes.

Dont freak yet. I admit you might be going down the same path (there are quite a few of us) but there is still a bit of time for you. Hopefully they find it when you complete your service request in a few weeks. I'm going to fight tooth and nail to get my september date honored when the time comes (if necessary). Even if it means getting all of my congressman involved, my relatives congressman, ombudsman, as well as calling into the CSC on a daily basis.

This is all assuming they actually issue an noa1 this century.

Unfortunately you can not expect much from an evil organisation (i realise thats sounds like a bushism using such a polarised label, but how else do you label an organisation that tried to deport widows of dead US soldiers who lost their lives serving the USA)

I CANT UNDERSTAND THE INCONSISTENCY OF USCIS SOMETIMES. I FILED 129F ON DECEMBER 31,2007. BY JANUARY 3 THE CHECK WAS CASHED AND NOA1 STATED JANUARY 4. I RECEIVED OFFICIAL NOA1 IN THE MAIL JANUARY 9. MAYBE THEY JUST PUT THE 129F'S RECEIVED THAT DAY IN THE BOX BUT FORGOT TO REMOVE THE CHECK AND OBSERVE THE NOA1. POSSIBLY IT IS STILL IN THE MIX TO BE ADJUCTATED IN LINE WITH EVERYONE ELSE WHO HAS RECEIVED NOA1 AND HAD THEIR CHECK CASHED. I WONDER IF ANYONE HAS EVER BEEN SKIPPED OVER FOR RECEIVING NOA1 BUT STILL GOT THEIR NOA2 IN NORMAL TIME.
