Hi everyone, K1 fiance visa holder here,

My wife and I married within the 90 days specified on my I-94 and are just completing the AOS forms. My question is this: is it perfectly okay for me to file for AOS after my I-94's expired, or must I do this within the 90 day period?

Sorry if this question's been asked before, but I'm a little confused and, obviously, very keen not to make any mistakes!!

You need to marry within the 90 days, you can file for AOS outside the 90 days without problems, many for for many reasons such as having to wait for a marriage cert, waiting to file taxes to provide a better financial picture for the I-864, needing to get vaccination records transfered to a supplement.

Yeah its fine,I filed later too,I had so much stress planning the wedding and then gathering the documents that I simply did not have enough time to send off the AOS within the 90 days.

As long as you got married in the 90 days you'll be fine.
