hello fellow VJ members,

My Rachel went for her medical today after waiting 6 weeks for her sputum test results. The test came back positive for TB. (bear in mind, she had 2 neg. result ant 1 pos. result) What a shock for the both of us. We Married last March and has almost been a year now waiting to be united again, and now , an unexpected turn in our lives.

Rachel has been the most honest and pure filapina (or even American woman) I ever met. and not to brag, but I have been her faithful husband she could ask for, and I am still here to support her.

I am sitting here stilll devistated with tears that this could happen.

I am undecided on what to do next. Plus understand I am not thinking too straight right now., so please excuse my post in advance.

My thoughts....I should fly there soon to console her, Problem is my passport expires in July. Now is Febuary already. there is a 6 month thing where I can't travel within 6 months of exeperation. Also,will I already have been exposed to TB? I am sure I was already vaccinated against it ,, but still.. not sure. So, first I better renew my passport.

I am sending her today for a second opinion, hopefully this will help.,

thank you to beng , and cherry (and others I forgot,,sorry,) for being her friend during your interviews, and please help in supporting her in this time of need.

couple more questions, should I abandon the k3 now and persue the CR1, since the treatment will take 6 months?. My K3 will expire Feb. 22,

How can her K3 expire Feb 22 when she had interview Jan 9 08 and how did she get a K3 or any visa before final medical approval?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

i am very sorry to hear that this happened you can have passport expidited so it is done in three week and go to the doctor just make sure.it like you said nothing probably but better safe then sorry just hang in there it will all be ok it is just another set back to test you you will be together soon. i know i would be so devistated my self but just get the things done you need to and then make the trip if you can good luck

Our K3 (NOA2 129f) approval notice was valid from 10/23/07 to 02/22/08, interview was suppose to be January 9, 2008. Interview was postponed due to something in the x-ray at medical and had to undergo the sputum test, so the K3 noa2 approval will not be valid in a couple weeks. Medical failed, so interview,, no visa.

I don't know how else to explain it.

Rachel was 2 out of 3 negative on the sputum test, also the pulmonary test was negative, only the 3rd culture was seen as positive for TB and she won't be re-scheduled for her interview until she does the treatment.(approx 6 months of it) It was also my understanding from previous post, that 2/3 negative was ok.

I also thought it was strange that the nurse talked to me on Rachel's phone to try to explain the results to me. If TB is an air born disease, wouldn't the nurse catch that talking in to her phone so close? Lately it seems there have been allot more post about the sputum test and I am beginning to think that St.Luke is infected with TB, and the air born particles are drifting into the test dishes that are used to collect the sputum. In the time I have known Rachel,(over 18 months) she has never been sick or has shown any symptoms.

I guess our journey will take a new path. in the wrong direction. I assume I will have to go back to USCIS and have our I-130 transfered to NVC and pursue the CR1 while waiting for the treatment to be finished. I will appreciate any info or help from anyone as to what we need to do from here. This has truly been an unexpected twist to our journey to be together.

Rachel was with us( pinktulips, beng and I) during our interview last Jan 8..She stayed with us in the hotel. We indeed had a great time. Its like being with an old friend!!! Her interview sched was supposedly Jan 9 but it was postponed! .........................

Achel, I know its painful and hard...Be strong and always remember that He has a wonderful reason/s for everything that happen!!

We will always be here for you and James!!!I will always include you in my prayers!!

u might also want to go get urself tested to make sure u dont have it already too and if u have it then u will get treated also.

sorry to hear about ur bad luck and i know it is hard to be seperated but thank God it something that can be treated and then she can be with u later.

Hi James & Sis Rachel,

Me and rachel have met in SLEC during my sputum exam, and also we have the same date of interview that supposedly last jan 9, but due to what happened we both end up waiting for the result of culture sputum, mine will be on feb 20, I can't explain how i felt when I've read this post, coz were on the same situations. Sis I know we will overcome this obstacle in our life. Everything happens for a reason and a purpose. God Knows Best for Us.

Continue praying and God is always there for both of you.... I know what you feel now. Me, too im waiting for 2 months for my sputum test result though i know that i am very much negative.... ye i have a history of TB last Feb 2006 but i undergone medication alreadyfor six months thats why when SLEC told me that i need to pass sputum sample i felt frustrated and down. But i just think positive for everything happen has a purpose. James, in this time Rachel need you more ... just always be there for her though you are not in her side.... you what i mean....and don't lost hope.

Extending the Petition

The I-129F petition is valid for four months from the date of approval from USCIS. Consular officers can extend the validity of the petition (revalidate the petition) if it expires before the processing of the visa application is completed.

Reinstatement of Visa ApplicationsCan visa applications be reinstated?

A Notice of Termination of Registration is sent if, after one year, the beneficiary fails to:

1. apply for an immigrant visa despite official notification from the National Visa Center or the Embassy to apply or respond to Packet 3;

2. show up for the visa interview without any prior written advise; or

3. take further action on his/her visa application that had been refused under INA 221(g) or due to lack of documentation.

Beneficiaries, however, may request reinstatement of their immigrant visa applications if, within a year of the termination notice, they are able to satisfactorily explain that their failure to pursue the application was for reasons beyond their control. Otherwise, visa applications will continue to be subject to cancellation procedures in accordance to U.S. immigration laws and regulations.

I guess your case do fall under 'reason beyond your control'... try calling NVC or USEM for the process on how to reinstate visa application.

Achel, Sis i know u feel hurt right now, but one thing for sure. God will never keave your side. Your endurance is just tested. Dont look at it as a bad sign, but look at it as a good sign. Find reasons sis to make the wait look shorter and better. I jyz will still be here tl Feb.25, pm or chat with me anytime you want sis.

Sorry to hear about your situation. As everyone already stated and implied, KEEP the FAITH. With your love for each other, nothing is impossible. This is just a bump in the road. At least, there is treatment for TB and this means that it is still possible for her to be with you. Just be strong (I know it's hard!)...and continually support each other.

I feel really bad for those individuals who confessed about their previous drug use. They are usually denied visa permanently and lose their chance to come to the US. Also, HIV patients. There's no cure...

Goodluck on your journey and with God's help, you will be reunited in no time.
