We are waiting at the NVC for the I 130 currently to process, but Since 1/29/2008 they requested additional evidence for our Fiance Visa ( K3 ). My question is If our I - 130 is processing currently how are we getting a K3 also if 2 cases were consolidated into 1 case? Does this mean he will come faster with just a K3 stamp on his passport and deal with I 130 here? Sorry I sound crazy I know and nobody can give a direct answer but if any other Middle eastern/ North African nationals or spouses have had this happen to them I'd be happy to hear what's going on exactly from their view. Thank you. :unsure::help:

Our I-130 was approved before our I-129F at the USCIS. The I-130 takes longer at the NVC (each consulate does it differently however). If the I-130 gets completed before the interview for the I-129F then the consulate will more than likely stop processing the I-129F and go forward with the CR1. The CR1 is a far better visa, and well worth waiting for, but most people here would rather get their spouse here with the fastest possible visa. If I remember correctly, if he gets the K-3 he can either wait for the interview in his country or he can come and change status.

If I am wrong please someone correct me.

I hope so I don't unerstand anything USCIS/ NVC are doing I'm back and forth calling each one. Im confused why I'm getting a k3 after being approved and sending information about my I 130 :unsure:

Your I130 was approved? That doesn't show up in your timeline. If it was approved and your k3 is still pending (that's not in your timeline either btw) then I would cancel the I129F. Seems like you need to sit down with whoever filed these forms for you and figure out the following:

1) what forms they filed for you.

2) what has been approved (you would have gotten an NOA2 for the approved forms) and what is still pending.

3) where these forms are.

As of last year sometime, when you file the I130 and then file the I129F, your I130 will stay at the service center you filed it with unless you file an additional form to ask them to forward it to the NVC.

You and whoever did these forms for you really need to sit down soon because you are wasting precious time if the I130 is collecting dust at the service center and they are waiting on further info for the I129F.

As far as updating my timeline I am not really computer efficient so Iam confused as to how to continue it but I will complete it when i have some time so other people in my situation can see it.

I have my I 130 in the NVC I got my approved in the month of december and back and forth with the forms. That is why I am confused I dont know if anybody else had this happen to them??? The k3 is now asking me for more evidence, an original marriage certificate and I already sent originals for the I 130 and K3 before. Ahh They made many mistaakes on the k3 6 months ago. Its a long hassle story. USCIS keeps surprising people with mistakes. I dont understand if i am waiting in the NVC how am I getting a request for evidence. I guess I will wait it out a week to see what's going on. :wacko:

I would call the NVC someone will talk to you there, I have called 2 times and talked to someone. They will explain what you need to do.

yeah of course I called them and waiting a couple of days as they said to recieve some papers through the mail for the k3 visa. I was just wondering if anybody else had this happen to them? How long will the k3 process take now since i am 6-7 months waiting for it and they looked at it everyday this past week 1/29,1/30,1/31. What is an estimate to get an interview yaddayadda yadda. :clock::content: :energetic:

I am not sure cos I just filed everything and went along with both of them and gave them what ever they requested. In the end we where very lucky to have him coem on the CR-1. He was getting the K3 stamped and then the Cr-1 hit the embassy and they just sent back his passport and then sent us an interview date for the CR-1 and then he was able to come on the Cr-1. I thank God that he came on the Cr-1. I know that mught not be much help for you.

If I was in your shoes I would just supply anything they ask for and which ever one he gets appoved of first then that is the one he comes on.

June 05, 2007 Interviewed and she said he was approved, kept passport and said will recieve in 4 days.

June 12, 2007 VISA IN HAND !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
