Hello, i live in the states and my fiance and i are waiting for our k-1 visa. Is it ok to live in colombia for a couple months while we are waiting for the visa? Also, i have one child that would come live with us and there is no problem getting the fathers consent. We will only stay a couple months. How could i find more info. and facts on how to do this? Thank You

USC has no travel restrictions

You need a US address and have someone send you anything that arrives from USCIS, NVC, and the Consulate, other than that you will be fine. You might check www.state.gov for requirements of extended stays in Columbia.

Where does your fiance live now? Who is the petitioner?

Assuming you and the child have US passports there should be no problem entering or leaving Colombia. Just make sure your stated purpose is tourism as you go through Colombian Immigration and make sure they grant a 60 or 90 day stay. You should not have any problems unless you state that you are entering Colombia "to live".

If the child has a Colombian passport, getting the child back out of the Colombia can be a little difficult but doable. You must have a notarized letter granting permission from any parent not accompanying the child and the letter cannot be more than 60 days old.

The fact that you live together for a few months will only make your petition stronger since it provides great evidence of a valid relationship.

I did the same thing last year while waiting for approval of the petition for our K-1. We lived in Bucaramanga. Where would you plan to "live"??

We will live in Bogota, and are you sure i will need fathers permission of my son even when he is not in his life? the real father is from the states. I am also from the states and my fiancee from bogota, colombia.. We wont be living there forever, just visiting for a couple months, 3-4 months, while waiting for visa. Would i still need a letter from the father when he doesnt even have anything to do with him????

As stated previously, this only applies if the child has a Colombian passport. With a father and mother from the US I assume the child has a US passport so the father's permission is not required to leave Colombia.

If you are planning on staying 4 months, you will be staying longer than the time normally allowed visitors to Colombia without a visa. I know some people who want to stay longer go to Venezuela or Panama before their time expires and then reset the clock when they return to Colombia.

I am contemplating the same thing - eastern euro. But, I worry that if I stay there until another shot at consulate interview, they will tell me that I no longer have viable work in USA to support my fiance and her daughter. I don't know how to address that concern if I were to mover there for some time. The way CSC is operating, I am easily thinking it will be another year before we get back to another consulate interview.

As cited by others, no need for a US Citizen child going to Colombia to have an absent parent's consent. Just make sure you have proof of your child's custody to avoid any issues if the father decides to cry foul later. And register with the Embajada in Bogota when you arrive so they know how to contact you in case of an emergency.

I stayed for 3 months, no problem...

Well versed on the visa pasport thing in Colombia. You get a stamp on your passport when you arrive in Colombia. Usually, 60 days. After you have been here 50 days, you go down to the DAS Office in Bogota(Cr 11 Y Cl 100 as I recall) They give you a banck account numer to deposit money into. You walk about 8 to 10 blocks West to the Bancafe and make a deposit of 68,800 Pesos (35 dollars) to the account, in you name. Take the receipt back and fill out a new one page form to stay. Takes about two hours total time. You can do this twice for a total of 180 days. Do not over stay. They charge you a hugh sum if you stay in Colombia too long. I got married in San Andres last week end, so now I can look forward to Colombia's paper work to stay here. Staying just long enough to get Rosa's visa. Now if everyone could just tell me where to start on that DCF.... Hope I have helped you. Retired Nebraskan, Colombian beauty, Eventually, Nebraska and then Florida bound. Elkfarmer
