Co-Sponsors, Direct Consular Filing

Hello again to everyone, my name is Nydia, and after some advice from some of you and consultation with my soon to be husband Neftaly, we have decided that direct consular filing sounds like the best option for us.

I have checked and El Salvador does allow for direct consular filing, and since I have been there for a year studying I am technically a resident there. I also can still claim my former residence with my mom as my US address.

Since I have been outside the US, I have no US income, so I was thinking about the co-sponsor option to meet the 125% above poverty line threshold.

Has any of you out there used the co-sponsor process? Any tips? Would the threshold include me since I would also be in in El Salvador and would therefore be a potential burden to the state? So would my co-sponsor need to make enough for a three person household, instead of just enough for my husband? Or would it be best to do the direct consular filing and then move to the US to work after I have filed to get some extra income and prove I don't have to be a burden to the co-sponsor?

Thank you for the tip. I will definitely check. I traveled there on a regular visa though. I was born in El Salvador and became a naturalized citizen before leaving to study there. My dad lives there, and I have been staying with him while I studied. I was there for a little over a year before coming here for what I thought would be a short trip. I hope I am OK, but I will definitely check.

P.S. I also got their verstion of the state issued ID, or the only document you can use for identification purpses, and which is known oddly enough as a DUI. =)

I also have a bank account and can probably prove residency through the University I attended.

hi,

We have soooooo many problems trying to find a co-sponsor. My husband (U.S. citizen) had been living in Denmark so he had no U.S. income. DCF was and still is the fastest way. So we ended up convincing his cousin to be a co-sponsor. This is how it works.

You will be for husband's main sponsor. Since you have no U.S. income you will need a co-sponsor too. That can be a family member, friend....who ever.

Their income will have to meet the requirements for a certain number of people. If they are single with no dependents then the household number will be 2. Them and your husband. You will never be included because you are a U.S. citizen. The visa is not for you and you can be as big a strain on the public system as you want to ;)

As far as you going back to the U.S. to earn some money....if you want to do it so you won't need a co-sponsor...forget it. You would have to wait until 2009 to be his sponsor because you will need for 2008 tax return to show your income and stability. And you will still need to meet the 125% income requirement for a 2 person household.

As a note.......if you end up like we did and can't find a sponsor with a high enough income. Then all you would need is the difference between their income and the 125% income x4 (i think it's 4 or 2) in assets or cash. That's how we did it.

Feb 27, 2007 - US embassy Copenhagen, I-130 re-approved and back

Mar 03, 2007 - Receive packet 4 - interview date April 12th

Mar 06, 2007 - Call from embassy - interview date is now on March 8th

Mar 08, 2007 - Interview at embassy - Visa approved IF medical report is all clear

Mar 14, 2007 - Medical exam

Apr 07, 2007 - Visa packet received

Apr 17, 2007 - POE Newark Intl. Airport

Apr 23, 2007 - USCIS refuse to change my mailing address

May 07, 2007 - Re-file for SSN

May 10, 2007 - USCIS receive visa packet from Newark

May 11, 2007 - Gets SSN

May 19, 2007 - Receive SS card

Jul 10, 2007 - Receive letter from TSC: greencard returned by post office - will re-send (duh!!!)

Sep 17, 2007 - Receive Welcome Letter

Feb 01, 2008 - Gets NC License - DMV will only issues it until Apr 17 08 (expiration date on entry visa in passport) since greencard not in hand

Mar 06, 2008 - After 10 months and some change GC FINALLY in hand!!

Apr 17 - Present: USCIS has managed to switch my case # with some else, send my greencard to the wrong address and had to make 3 - yes 3 - service requests on sending out my card
