Hi

I unfortunately owe about $4,000 in bax taxes that I am trying to take care of this year. Does anyone know if this will affect my fiance arrival???

As long as you make over the required amount, and have filed your taxes. You should be fine.

I actually heard it WILL affect the visa, unless you have a payment plan set up with the IRS. The amount does not need to be paid before the visa is issued, but you'll need a repayment plan in effect.

A Visa lawyer told me this, you may need to check. I'm in same situation, but I am straightening it out.

What you owe in back taxes will not affect the outcome of the k1. Back taxes is considered "debt", and they are just concerned with your income, not debt. They dont care how much you owe in taxes, in credit cards, etc. Just want to know that you are making over poverty guidelines.

So as long as you filed your taxes, your K1 should be ok... However, do know, that the IRS does not forget about you :P A guy my husband works with thought that the he can just repay the back taxes when he likes, and the IRS is now garnishing his wages.

As whack as it is that they do not check into your debt load, it will not effect your K-1. In our case, it was a good thing.

I fear one of these days, they will change those rules.

All that matters is you file tax returns and make over the 125% threshold for your projected family size. The DOS is not the IRS. i.e. When and how you pay is for the later to worry about! :lol:
