Timeline

In 2002 I petitioned for a Russian woman to come here to the U.S. She came and stayed for 3 months. She went back to Russia after the 3 month period (we never married). We were simply incompatible.

Now I find myself filling out the 129F again. Will it hinder my attempts to obtain a K-1 because of what happened 4 years ago ? Or, does it make any difference?

You should be alright just document what exactly happen. Did she overstay the 90 day’s here in the U.S.? Probably someone will answer this thread that had the same situation. :D

There are members past and present who have petitioned again for a fiance after having petitions previously. Just complete section 13 on the I-129F.

I know I read somewhere where they are looking at introducing a limit on how many fiance petitions one can file for in a given period of time but to my knowledge that hasn't been set in motion yet.

There is a question on the 129F asking if you ever applied for a fiance before. Make sure you answer giving her name, if the petetion was approved, type of petetion, and service center it was approved at. Then include "see suplement question 13" anyway I think it's question 13......then explain your circumstance of the past relationship. Include what you explained on VJ plus how she returned (any proof) and what if any contact you had with her after she left.

As far as it hurting you you should be ok except the new laws limit you on the number of fiance visas you can apply for within a 2 year period. when in doubt disclose........take care.

Timeline

The new laws on limits (and on "international marriage brokers") were to be put in place in March. Full implementation was to take appx. 45-90 days from then. So, maybe May/June? I want to say it only limited people to TWO requests per two year period or something like that. If you've only had the one other request, it shouldn't be a problem, just disclose the situation on a quest. 13 continuation page.

There is an old thread somewhere about the new laws and a link to the actual law itself.

May be worth checking out, but if you send in your K-1 packet soon, don't even worry about it as it won't affect you.
