K3 No longer a valid visa!!!!!!

I know my 129F has been canceled. I saw it on USCIS archaic computer system when I had an unsuccessful interview to correct information they had sent me about my wifes visa. I called USCIS and they deny it all, just tell me to call back. My congressmember's office just called the other day checking on the I130 and was surprised to hear they canceled my other application. I will update you guys when she calls me back. What I like the best is that USCIS contract personal and their website say it is active even though I saw with my own eyes on their computer that it had been canceled. I have no doubt that nobody knows what is going on there.

So i called CSC today and was told by a rather rude lady that I am only allowed to call every 30 days.

I still made her check my petition only to find out that it was still not assigned.

Then she finished the call by saying try next week.

I think they are all insane

Wo are you serious??! Did you get her name? Was it, by any chance, Becky? And was she asian with a really really strong accent? That's who told me the same thing: I call too much (See my timeline). She told me that I should know better than to call within 30 days after making a phone inquiry.

I am soooo angry right now but would like to share the info. In deed, at least for the Vermont center, they are canceling the I129F petition and moving only the I130. I just talk to an officer via the RFE trick, and he confirmed the I129F cancelation and refused to give me the status off my I 130 ?? stating some internal regulationon prohibiting that (weird as i head a lot got this info throught the Phone)

I don't know what to do else, invlove a congressman/senator to revive this 129 F (if there is a chance) or jsut absorb my anger and get in the waiting line for a long CR1 Visa track? please any idea in that regard?

I first read this new months ago, it was posted by a member here that her k-3 was canceled or something, I freaked out and was THOROUGHLY confused.

I have not read anything on the uscis website, nothing in the weekly newletters.. and we have ppl of VJ getting approved for k-3's. I think we are ok. :fingers crossed:

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Well Mine was cancelled even before my I-130 was approved, and I started to cry on the phone when I first heard it. According to CIS Ombudsman I-129K will be "Administratively Closed" once the I-130 is approved. My wasn't approved and I called back to see why my I-129F was cancelled and they are in the process of Investigating this, and I am hoping they will re-open my I-129F. I am being patient and waiting until the end of this week to call USCIS on a status on my case.

OK, Has anyone recieved any documentation that states their I129F petiitions was closed? has anyone logged into the USCIS website to check their status and discovered that their I129f petitions was cancled?

Because I have a friend, Devine Mercy, you can find her in the Nigerain portal, that was told the same thing by 3 USCIS people after doing the RFE trick. Her I130 was in storage. She had it forwarded to the NVC to get the CR1 back going, since she thought her I129f/k3 was going to be terminated. This lead me to think the same thing, because my lawyer sent out my I129f petition out 2 months after the reciept date of my I130. The reciept date for my I129f is 2 days AFTER my approval date of my I130.

Ok, I had dropped of the visajourney site for a couple of weeks. I logged back in to check Devine Mercy's process to discover that her I129f petitiion was approved and she was now going for the K3 visa instead of the CR1/I130.

She stated that she did nothing. The information she was getting from the USCIS office was a lie. There would be a policy in place if this information was true.

I do know that if your I130 reaches the embassy before your I129f they will terminate the I129f.

Which for me would be devistating because it is a 2 month wait for an interview for the K3 and a 7 month wait for the CR1

We've been told our K3 was closed due to I-130 approval . When we called again to inquire about that an officer told us about presently empty folder where BOTH petitions was before. We have never received any "cancellation" letter.

We gave up. Fortunately, in Poland interwiews for both K3 and IR are relatively fast.

BTW As of today on-line status for I-129 is still pending. Also the fee was waived.

I guess I ought to chime in here. Take a look at my crazy *ss signature if you are in doubt.

I was at the VSC. My I130 was approved in less than two months. It was sent to the NVC to start processing for the CR1 even before my I129F made it to VSC from Missouri (where it went after chicago). My husband is Nigerian and I'm sorry to all of you who are CR1 going through Nigeria.. that's a near impossible visa to obtain in Lagos even after you wait approx. 7-12 months for a CR1 interview.

In October I was tired of waiting for the I129F (I did NOT process the CR1, I asked the NVC to store my I130 because I wanted the K3). I asked my senator to contact them to see what the wait was. He was told I was not yet outside processing times and I had to keep waiting. Fine. No mention of being terminated.

In November I called using the RFE trick. I was told that my I129F was still "pending" but their new "policy" is to cancel it when there is no longer a pending I130. I didn't believe it. I called again. I was told the same. I asked to speak to a supervisor. I was told for a 3rd time IT WILL BE TERMINATED when it reaches an adjudicator's desk.

I freaked out. I went to my senator's office and cried.. begged... pleaded with them to fight for the K3. They wrote the Congressional contact at VSC. The letter they got back stated that I will be terminated because I no longer have a pending I130. That is their policy. I no longer NEED the K3 because I have the I130 approval.. the purpose of the I129F is to bring the spouse here to wait for the I130 approval. They didn't want to hear about the longer embassy problems with the CR1. They don't care. They insisted that they were actually saving me time AND money by doing this FOR me. To them, i was saving time because I wouldn't have to endure the long AOS process. They don't consider the TIME APART from my spouse, only the time in dealing with immigration.

I was crushed. I cursed the USCIS, George Bush.. God even.

I pulled myself up by the bootstraps and asked the NVC to reinstate the processing of the CR1. Back to square one, many months behind.

I paid the fees, I sent the documents.

I paid the last CR1 fee and a week later I got an email from USCIS: You're I129F has been approved.

WHAT?????? WOOOOOOOOOOOOOO HOOOOOOOOOOOOOOOOOOOOOO

Someone forgot to tell the adjudicator about the USCIS policy.

I never sent in the last papers to complete the CR1 process. Today hubby went to the embassy and picked up packet 3. We now have a K3 interview date of April 22.

Unless your case has officially been terminated, don't believe a word they say. They don't know what they're doing or saying. They sh*t from their mouths. If it makes you feel better to pursue the CR1 thinking your K3 is dead, then by all means go ahead. From November till January that kept my itsy bitsy hope alive. I paid $830 for the CR1 that I will never use but I would never undo the I129F approval.

Good luck in your journeys. Don't let these turds keep you down. You WILL be with your SO. They will block you and screw you and make you crazy but in the end, your husband/wife will come home and you will be stronger for having fought for it.

We're all kind of speculating here but I'm not sure the fee issue has much to do with this. It might but the policy has always been that an I-130 for a spouse could only accepted when an I-130 was pending. In November 2006, USCIS decided they'd save NVC and the Consulates a lot of waisted efforts chasing I-130 related paperwork by simply holding the I-130 on the assumption the K3 was what the petitioner wanted. Last summer, they changed another policy and directed K3 filers to submit the I-129F to the service center where the I-130 was pending. They did this before the change in fees.

I'm wondering whether somebody got the intelligent idea that since both petitions were being approved together, it was against the law to continue the I-129F when approved together with an I-130 because, back to square one, the K3 petition can only be filed when an I-130 is pending. No pending I-130, no need for the I-129F K3 petition. Of course, this is a royal Catch 22 for the unsuspecting petitioner that really wants the K3 route and is further magnified for those cases with children for whom not I-130 was filed.

It's totally FUBAR. Until something changes, I would advise nobody to file an I-129F for a spouse. K3, if not dead, is taking a nap.

Facts are cheap...knowing how to use them is precious...
