K3 No longer a valid visa!!!!!!

I talked to CSC AGAIN today and asked specifically about the cancellation of K3's. I was told that YES, K3 applications are now going through an "administrative closure" after the I-130 is approved. It started late last year, I was never given an exact date. Those of you whose K3's are now with the NVC were perhaps processed before this went into effect. I don't know. What I do know is that it isn't worth filing the K3 visa application and may slow you down.

How can anyone say anything for certain?

Clearly the uscis documentation contradicts what they say on the phone, and not everyone gets the same information when they call. I would say half of the users have posted to this topic have stated that the K3 is still valid, and other have seem to be certain otherwise. I just don’t understand how anyone can tell other users to not file for K3 when just in this topic we see contradictions in the information gathered!?!

So i called CSC today and was told by a rather rude lady that I am only allowed to call every 30 days.

I still made her check my petition only to find out that it was still not assigned.

Then she finished the call by saying try next week.

I think they are all insane

Please help Visa Journey members! We are DESPERATE for answers! People that have applied for the I-130 visa AND the K3 (seems like after July 30, 2007) are automatically getting their K3 visa application cancelled for no apparent reason! I am absolutely devastated as my husband (USC) sent in my I-130 application on August 7th, we waited 51 days for our NOA1, then submitted the K3 application. We are HOPING to have our NOA2 for K3 by the end of March but now, I am almost having an anxiety attack just thinking about it. Please read:

The problem is is that it will cost a lot of money and even MORE time (which is the most precious) to then submit an I-130 for my son, then have it catch up to my I-130, then to fly all the way to Montreal for the interview (approx. $1500 for 2 of us) rather than Vancouver for the K3, as well as hotel accomodations. It is more important for most filers to be together sooner & have extra expenses on AOS, rather than the money gained from employment as soon as we enter the US.

WE ARE BEGGING YOU TO PLEASE HELP US WITH THIS SITUATION ASAP....MANY PEOPLE HAVE ALREADY HAD THEIR K3 VISA APPLICATION CANCELLED! THIS IS FRAUD ON BEHALF OF USCIS!

i love the presentation of ur letter to the cisobudsman, as u point out the advantage of k3 when going through vancouver,it save time, money, and energy, to go through montreal for cri.

Thank you for writing that letter. We will be sending one as well, due to being in the same boat. Having our I-129F cancelled and having to go with the I-130 would cost us an additional six months or more by dealing with Montreal vs. Vancouver. We just want to be together!!

Hi Annie & Tim, I am more than happy to TRY to get answers, yes PLEASE be sure to mention Vancouver is approx. 2-3 months before interview VS. Montreal at 4-6 months, I forgot to mention that point...thanks...

Hey guys.. I am from the other forum (I2us) I've been reading about this and finally had to post..

I filed the I-129f a few weeks ago before I knew about any of this and now I am REALLY wishing I did not! I had filed my I-130 in very early November and WOULD be 3 months into a '6 month wait' if it wasn't for this.. Is this really happening? Has ANYONE who filed for a K-3 after July 31 / no fee been approved ??

Yes, I filed my K3 on Aug. 20 and it was approved on Jan. 9 at the same time as my I-130 and the K3 was filed with no fee. The I-130 is being held at National Records Center and my K3 is being forwarded to the NVC.

I certainly hope there are no problems with K-3s. So far, things have been moving along as expected for us. Of course, I am using an attorney.

I filed (using attorney) our I-130 at the end of October. Receipted in January and then sent the I-129F.... I-129F was receipted within a week and we received (snail) mail notice yesterday. I've been instructed by my attorney that it is currently taking between 110-150 days from the receipt date until USCIS approval, and then another 10 days before we receive a NOA.

We've been trying to follow all USCIS instructions to the letter. We don't expect to hear anything before mid May, but still keeping out fingers crossed.

Best of luck on a quick process... and hoping they don't throw us any curve balls....

Well I had a petition for i-130 approved and sent to the NVC as my 1-129f(k3) is still at uscis california..It is like they bypassed my K3 application. When in fact, I stated right in the beginning that i wanted to go with k-3 visa..Now i have to wait forever..errr!

What I am reading in this tread does make scense. For some odd reason my I-130 and i-129f were not paird together. I am a late July (I-130) filer and early Aug (I-129f) filer. So I only paid the $199 for both applications. Which to me never seemed write, but I wasn't to complain. My I-130 was approve some what early. I'm thinking now if the two were paired, then I would still be waiting for an approval.

Did the notice I797 which approved your I130 instuct you to file form I-824. Have you filed the I-824? My I-130 was approved 1/29/08 and instructed me to fiel I-824. The same day my I129F was approved and instructed me my to file I485. Insturctions said my I129F would be forwarded to NVC but the I130 instruction did not say the file would be forwarded to NVC.

Our NOA2 says same.

If I were you I would start calling NVC if they've received it and asigined case number. Also James' shortcut, will be helpful (in VJ wiki as Jame's) if you want learn how to make next steps fast.
