K3 No longer a valid visa!!!!!!

Hello, I'm a little lost as far as the RFE line goes. How do I get through? I've called the USCIS customer service number and found 2 ways to get to talk to a person, but the both had the same information. So, if you don't mind.... please spell it out for me in laymens terms how to get through to the place you got through to. Thanks :blush:

I-130:

Married: 5/27/2006

Sent: 9/4/2007 (Vermont)

Check cleared: 1/25/2008

NOA1 : received 1/28/2008

NOA2 : received!!! 4/13/2008

NVC: First package arrived - AOS Fee sent: 4/23/2008

I-129:

Sent: 1/29/2008 (Vermont)

Received: 1/30/2008

NOA1 : received 2/7/2008

NVC Received (I-130) : 4/27/2008

Consulate Received : 11/27/2008

Packet 4 Received : 10/12/2008

Interview Date : 1/12/2009

that kind of helps... i didn't know what RFE ment, :blush: but what I ment was... exactly what numbers do I press or what menus do I want to select? *shrugs* but another question I would like to ask is... how much longer do I have to wait before I can check my case status online? I got my NOA1 on the 28th, and they cashed my check on the 25th, so I figured I would be in the system already, but online it tells me it can't find it, and using the 800 number I'm told to check it again to make sure it is correct.... which.... yea I can understand getting in wrong once, but I didn't get it wrong, on the phone or online..... so, how long does it take to get in the system? I thought that once they send me my receipt notice, that I'm in the system.

Normally I wouldn't mind so much, because I can understand that they aren't very organized, but since I sent my I-129F with a copy of the receipt notice, I don't want it to be delayed because the number on the notice doesn't work for the system... know what i mean?

Oh i understand now... i've read some posters also couldnt check their case number online..( i dont know though what's the exact reason why they couldnt see their cases online) and the hotline 800-375-5283...

Longer Technical Answer:

I had the same situation when I got my NOA1. It would appear that the online system is a different system to the one they use to put the case on and get a receipt number. Because all the cases are now getting logged onto the system in chicago they are not being put on the online system straight away. Give it a couple of weeks and it will be on. Mine took 2-3 weeks. I'm assuming the online system gets reports from the other system periodically.

Give it a few weeks.

Well when I sent in my I-129 F (K-3) I did send in the payment, I send it July 24, they rec. on July 29, but didn't put it in their system until August 1, and they ended up send me a letter and the fee back! I should have checked that out then. But regardless I sent in my I-130 in Novemeber of 2006... My I-130 should have been approved by now!!!

This is the exact thing that happened with us. I could give a rat's ### about the money. I never asked that they waive the fee. I am going to be in on the USCIS Ombudsman Teleconference call today and will ask about this.

I just called USCIS and I got a little bit more details about my case - went through RFE line (I found out that this line is actually the California service center :yes: ) and they advise me that the reason why my K-3 visa was cancelled was because the officer that was handling my case closed it out in light that my I-130 would be approve after the Security checks... I pray to GOD it's like really SOON!!!!! My husband country is torn with Political violence right now, I even had to cancel my trip to see him today :crying: because of it!!!!

the way the RFE line works is it figures where ur case is and tries to route the call, its even smart enough to read your caller id information and figure that the call is from east coast or west coast or the other 2 time zones based on which it might allow u to connect thru between 8am-6pm (based on the orignating numbers location), i personally tried it from east coast but my corporate mobile phone is based out of california so got thru inspite of being told that the service center is closed when i called from the east coast landline.

one thing to note even if you call at 10am EST and your case is in california you would get an error saying that the there is some problem some BS but the issue actually is that the CSC hasn't still opened for business i.e. 7am PST. so maybe always call from the east coast between california 8am(PST) to 6pm(your local time)

If I were talking to a USCIS adjudicator throught RFE line, this is what I would want to say/ask.

In the recent past, I-129F for spouse and I-130 petitions were joined and approved together with the USCIS holding the I-130 petition for adjustment of status. Has that policy changed? Is it now the policy to simply cancel all I-129F petitions when the files are on the same desk? When did this policy change? Is there a press release on it? Do you realize this effectively renders the K3 visa dead?

So this in interesting because I know my 129F has been canceled, I saw it at a service center on the computer screen with my own eyes on Janaury 11, 2008, I filed the I-130 on May 18, 2007 and the I-129F was sent in July, received at the end of August. The lady could not tell why it was canceled, she could not even get anyone at CSC to answer the phone. I have yet to receive a notice about it and when I check online it says it is still in process. I would be surprised if anybody knew how the system is operating at this point. At least my I-130 was approved on January 14th and received by NVC on January 28th. Thought some of you would find this interesting. At least when it gets to the embassy it will be clear sailing, considering embassy employees were at my wedding.

Good luck to you all. Remember to share your experiences with your congressperson/senator and write to your local media outlets to expose the problems that are abound in the USCIS.

So, now few people have received hard copy NOA2 and their I130 have been forwarded to the NVC. USCIS has canceled the K3s that have been filed in late july with no fees.

My question is that I paid the high fee ($355) with my I130 and so no fee for the K3 application. Will they cancel my K3 too or does that only apply to the people who only paid around $150 for the I130 and no fee for the K3 as USCIS returned their K3 checks that time?

I am in the same boat, well the VSC boat! and our timeline are quite similar. I called the helpline and they told me if the I-130 does in fact get approved first, then they will cancel the I-129 K3. She actually had to put me on hold for about 10 minutes while she got the answer and I certainly appreciate her not winging an answer or giving me self-created 'misinformation' I told her that I wanted my K3 process to continue as I was not given a choice. She said to write a Letter by post to VSC and state that I wanted to continue my K3.

So now I am really struggling to think if I write this letter or not, will it confuse the Immigration officers, maybe delay my case further.................DO NOT KNOW WHAT TO DO!

Any other comments or suggestions out there!!!
