K3 No longer a valid visa!!!!!!

hi,do you know how long for IR-130 to finish process this time since yours was approved dec.? any idea ???

It was our first question asked, after nvc asigned case number. They're not giving timeframes.

We can only assume by reading VJ :). On CR/IR forum there is one timeline says an average 02/2007-11/2007 is 104 days but only for nvc process. There's an aditional time until petition gets from uscis to nvc (1 to 4 weeks)and aditional waiting for interview - different for each embassy.

We are at day 50th today, using Jame's shortcuts. And we guessing another 3-6 weeks or...3 months until case complete at nvc.

The USCIS 800 number is called the mis-information line by many on this site for a reason.

In fact it is the other way around, if an I-129f is submitted for K-3, the USCIS will hold the I-130 and just send off the I-129F for K-3 visa, they do not send off the I-130 for CR-1.

The USCIS 800 number is called the mis-information line by many on this site for a reason.

That is quite uncalled for Devildust... Until USCIS release an official statement we do not know EXACTLY what they are doing. YuandDan and the people that have been here longer are corret that the customer service line is notorious for giving out bad information and lying through their teeth. We know they are making an across-the-board statement which is false because people are still being approved for a K3. That "blanket statement" caused lots of worry and heartache to several VJ members who thought they would have to see the I130 through, only to find a couple of months later their I129Fs were also approved.

What we are trying to gauge is whether the people still being approved actually PAID for their K3. If that is the case, then it looks like all people who got theirs free have no say in the matter but, if you did pay for it, then you will get it. That is still an assumption though, because we have nothing in black and white. Their customer service line needs to distinguish between those 2 catagories.

Still though, the official statement has not been released and USCIS need to do so. It is a big change they have made without notifying anyone and they are allowing people to delay their own I130 approvals for a petition that will be cancelled anyway.

Just to have a bigger sample size: We paid the OLD fee for the I-130 ($190.00) and then NO fee for the I-129F (waived). And later on were told that the K3 would be cancelled.

I think this could be the situation. Folks who paid the NEW I-130 fee ($355) and then NO fee for the I-129F (because now it's free) will be "safe". It sucks for me and a couple on VJ, but it makes SOMEWHAT sense. I just wish they would have said something...We would have paid the extra money to ensure we'd be reunited quicker. Hence, Family Reunification! :wacko:

Summer 2004: Met while on J1 visa; J1 internship was 3 months (subject to 2yr-HRR)

I had a similar situation here,this is so crazy this immigration people is jus making our lives miserable by confusing us all.

Anyway I also sent my 1129f a week after I'got my receipt from the 1130 the only time I heard from them regarding my 1129 was that it was being transfer to another location I son't remenber wich one,but they procced with my 1130 we're at a consular state right now everything went smoothly with the paper work and everything,yerterday I received a letter fom uscis claiming that in order to process my 1129f they need a "valid marriage certificate" they claim the one I sent it's not valid in El Salvador?? I didn't get married in ES,we've got married in the Dominican Republic why is this need to be valid in ES?? whatever all I know is that my papers are in order at this point as the people in the embassy never mention anything about my marriage certicate so I'm sticking to that. I don't know what to think anymore,and I don't want to get anymore worry that what i'm right now ,having to travel to ES to be with my husband for a second interview on Tuesday 5th, good luck everybody and God bless

My K-3, for my wife, got approved yesterday by USCIS. So they may still be valid. But I did pay a fee for both the I-130 & I-129F, beating the July 31 fee increase.

If everyone who gets their K3 approved/cancelled could confirm whether they paid the fee or not, that could put an end to the uncertainty.

We didn't pay for I-129 and it got cancel.

We've been told about policy: when I130 approved before , I129 got cancel. The thing is both where assaign to the officers on the same day.

I'm sure the k3 is heading to extinction.

I just called USCIS and I got a little bit more details about my case - went through RFE line (I found out that this line is actually the California service center :yes: ) and they advise me that the reason why my K-3 visa was cancelled was because the officer that was handling my case closed it out in light that my I-130 would be approve after the Security checks... I pray to GOD it's like really SOON!!!!! My husband country is torn with Political violence right now, I even had to cancel my trip to see him today :crying: because of it!!!!

the way the RFE line works is it figures where ur case is and tries to route the call, its even smart enough to read your caller id information and figure that the call is from east coast or west coast or the other 2 time zones based on which it might allow u to connect thru between 8am-6pm (based on the orignating numbers location), i personally tried it from east coast but my corporate mobile phone is based out of california so got thru inspite of being told that the service center is closed when i called from the east coast landline.

one thing to note even if you call at 10am EST and your case is in california you would get an error saying that the there is some problem some BS but the issue actually is that the CSC hasn't still opened for business i.e. 7am PST. so maybe always call from the east coast between california 8am(PST) to 6pm(your local time)
