K3 No longer a valid visa!!!!!!

Hey everyone. I filed my I129F in late July also. Both of my petitions were approved together on Jan 9th, 2008. I received a letter from NVC yesterday stating my husband should receive his packet within the next 2 weeks.

Not sure why they are telling some of you that they are not doing the I129F. The letter from NVC was about the I129F not the I130.

My petitions went to California. Is that where most are going?

The USCIS 800 number is called the mis-information line by many on this site for a reason.

In fact it is the other way around, if an I-129f is submitted for K-3, the USCIS will hold the I-130 and just send off the I-129F for K-3 visa, they do not send off the I-130 for CR-1.

Both my I-130 and I-129F ..........are moving forward. I'm going to cancel my K3 now. I doubt they're going to hold my I-130 once it reach to NVC.

My husband filed K3 last October 2006 and last February 2007 he filed iancee visa visa for me.... K3 visa was aprroved October 2007 and fiancee visa was approved November 2007. hence my K3 visa was approved first and NVC sent me an schedule for medical Test and US Embassy Interview so my fiancee visa was ignore. So i think K3 visa was still okey. I don't know? But just hoping everything will be okey...

You mean CR1/IR1 (I-130) not K3 (I-129F). as what your timeline says. My CR1 approve a day before my K3 approve. umm I'm gettin' a hard time understanding your post. Sorry po.

Ok folks. I am very surprised by the message I just recieved from my husband. The Officer at CSC that my husband talked to last night (through the RFE line), and who took our phone number, and said would look into our questions, and call back, ACTUALLY CALLED BACK! :thumbs:

The Officer called back. She left a message.

Her exact message: The I129F did slow it down. It went to the filing of the I129F date instead of the I130 date (as we suspected). She sent our I130 to division. End of message.

Nothing refering to 'cancellations' of the I-129Fs. I guess we know they are going by I-129F receipt dates, and not I-130 reciept dates for those of us who filed for K3s. :unsure:

I'm still in shock the lady called back!

Summer 2004: Met while on J1 visa; J1 internship was 3 months (subject to 2yr-HRR)

2004-2008: Visited US on B1 / Steve visited Nicaragua as well (living in different countries! while I fulfilled 2yr-HRR)

Jan. 5, 2009: AOS Interview!!!!

Jan. 15, 2009: Legal Permanent Resident!!!!

N-400 NATURALIZATION

Eligible: Jan 15, 2012

Nov 4, 2011: Sent N400 to Lockbox / Delivery confirmation on Nov 7, 2011.

I talked to CSC AGAIN today and asked specifically about the cancellation of K3's. I was told that YES, K3 applications are now going through an "administrative closure" after the I-130 is approved. It started late last year, I was never given an exact date. Those of you whose K3's are now with the NVC were perhaps processed before this went into effect. I don't know. What I do know is that it isn't worth filing the K3 visa application and may slow you down.

Many have tried that only to get both I-130 and I-129F canceled, the cases are linked, and only way to keep the I-130 moving on to NVC is by filing I-824 requesting the I-130 be sent on to NVC for counselor processing into the CR-1 visa.

The decision must be made if you want CR-1 or K-3 BEFORE you send in the I-129F.

Are you somekind of imigration law attorney or very knowlegeable person about to know all USCIS/NVC process? do you you have a connection inside NVC/USCIS to to know all the process. or you just contend to believe USCIS press realese back in 2006??

Boy the party never stops with USCIS. I guess its a sadist halloween that goes year round.

I think we all should wait till Friday and see what kind of concerns are addressed in the CIS Ombdusman tele-conference.

Those of us who have filled the K3 recently because of the NOA1 delay on the I-130 there were very few people who had success filling K3 without the I-130 NOA1. So, when there are very few Aug, Sep, Oct, Nov, even December fillers for K3, things should move faster because there is nothing in the queue. All I could say, people wait and watch. USCIS is unpredictable and would do what they want to do.

Exactly, this again proves they are not following a procedure 100%. The letter in question is the one from NVC which confirms that the I129F has left them and that a packet will be received from the local consulate within 2 weeks.

I really hope if anyone manages to get on the call with the ombudsman that they bring this up. Especially the fact USCIS are doing this without pre-warning and no official statement. They need to start focusing on the whole journey, not just their part of it.

I also want to chime in to remind everyone that the USCIS officially states that the correct filing procedure is to send the I-130 in and wait for the NOA1 (and transfer notice if you filed at the new Chicago lockbox per their updated filing location instructions). Once you have the NOA1 then you should file the I-129F at the Service Center the underlying I-130 is being processed at (as listed on the transfer notice / NOA1). I see many people filed them together to the lockbox but I am just citing what they say on the official USCIS instructions.

Hi, yes we followed the instructions at the USCIS site. and im confused why those who filed both ir130 and 129-f (k3) were received an NOA? i didnt know its acceptable? and some were approved from the k3?????? how is that?????????

My K-3, for my wife, got approved yesterday by USCIS. So they may still be valid. But I did pay a fee for both the I-130 & I-129F, beating the July 31 fee increase.

If everyone who gets their K3 approved/cancelled could confirm whether they paid the fee or not, that could put an end to the uncertainty.

We didn't pay for I-129 and it got cancel.

We've been told about policy: when I130 approved before , I129 got cancel. The thing is both where assaign to the officers on the same day.

I'm sure the k3 is heading to extinction.
