Applied for I-130 as Permanent Resident, now almost Naturalized

I was a permanent resident when I got married and filed the I-130 for my wife. Now I'm about to finish the naturalization process, and will need to "upgrade" the pending I-130 so that it can be processed as for a spouse of a citizen instead as for a spouse of a permanent resident. (See sig if still confused.)

Has anyone here done this "upgrading" process before? I talked to a lawyer who said to simply file for a K3 and it will automatically get upgraded. However, from researching on this and similar sites, I've found conflicting opinions on whether to file the K3. Some seem to say that since june 07 or something, if you file an I-130 and for K3, the I-130 is not processed until the K3 process is finished? Others said that they filed for both and the K3 was automatically cancelled? Or that the K3 is a lot more expensive because you have to file for adjustment of status ($1010?)?

So we're still debating whther or not to file for the K3. But if we don't this is what I plan to do for "upgrading":

Send:

  • a cover letter requesting the upgrade
  • a copy of the I-130 NOA
  • a copy of the naturalization certificate
  • a copy of the marriage certificate
  • a copy of a bank statement with both our names on it (to show we have common assets, since this seems to be a new requirement since we first filed the I-130)
To:
  • California service center (where I-130 was sent)
  • Chicago "lockbox" (where uscis website page for I-130 says to send I-130 effective December 2007
  • NVC (what address? this page says to send upgrade requests to NVC...)
  • anywhere else the USCIS help phone line people tell me to

I'd be grateful for any more tips :)

2008/03/22 - Received AOS Fee bill
2008/03/25 - DS-3032 entered into NVC system
2008/04/07 - I-864 and IV Fee Bill generated
2008/04/11 - Sent I-864 form and documents to NVC (JSC)
2008/04/14 - Received IV Fee Bill
2008/04/14 - Sent IV Fee payment to NVC
2008/04/21 - Received I-864 packet
2008/05/02 - IV Fee status on online system changed to PAID
2008/05/05 - DS-230 generated
2008/05/06 - Sent DS-230 form and documents to NVC (JSC)
2008/05/08 - DS-230 entered into NVC system
2008/05/12 - RFE for an item I sent and an item that is not needed
2008/05/13 - Called NVC to explain why RFE is bogus and ask for re-review
2008/05/19 - NVC COMPLETE[/color]
