Background:

Married Wife in Japan 12/31/07

We would like her to visit if possible in May. it seems like it is okay for her to visit but most people have suggest bringing proof that she will return to Japan. She does not have a job so no proof there and she is pregnant and is due in September so I am worried they will think her to try to be staying in the United States to have the baby.

Would you think that having a written document or a reservation at the hospital in Japan would be enough proof? Besides that, I cannot think of a way to prove her return has she really has nothing depending on her in Japan.

Any suggestions?

does she have a lease or own her apt/house? some people have used proof of property as ties to their country

I am in the same boat as you. I have been married for 6 years and my wife is pregnant, due in June/July. We filed our 130 and are waiting to hear something. I told my wife to just be confident and tell the they she would not do anything to jeaprodize her chance of getting a GC. I do have one thing that might be different from you however, my wife will be traveling with our son who is a USC. My wife is coming up to spend our annivesary, and birthdays. My wife and I have little to nothing left in Brazil except some joint bank accounts and some investments as I was transferred last year. Unfortunately I knew nothing about the DCF process and waited to file when I got here.

When is your wife planning on coming?

My husband and I are planning my visit to USA in Apr/May. And like you guys, we are worried too. So, he will fly to Malaysia and we will fly back together. Don't know how much difference that will make but having him beside me will make me feel better. At least if I am being denied entry, he is there and not waiting in the Arrival hall wondering where I am. :P

But I do know you need evidence to tie your spouse back to her home country.

Will she have a return ticket? If so, when? Since your wife is pregnant, is the return flight after her 7month mark? I guess some airlines don't allow pregnant women to fly after 7 months. This could cause a return problem...either planned or unplanned :) These are just question she may encounter depending on her return flight date. just my opinion though...no experience as such.

As a side note to my above remark, I'd be careful if you're planning to create a situation where she might not be able to fly home due to her pregnancy. I'm not sure what the laws are or even how long she is able to stay. Part of your post sounds a little shady to me. I'd just be careful if your planning to "skirt" the system...even if just a little. You surely don't want to create a situation where she would be denied entry at a future date.

A return ticket with just a month's stay would be a good start. It isn't a guarantee however that she will be allowed entry, considering the circumstances that you have mentioned. Goodluck!

Plane Ticket? I don't think a plane ticket could guarantee anything..

Anyone could buy a plane ticket.. I can buy one right now and can choose to opt the flight for no reason..

I'm in the same situation as well, because my husband doesn't have a job in his home country, or a bank account or anything. All he would have is a return ticket.

As other people have said, it seems safer to not have your wife visit in case of a problem with the pregnancy. If she can't get back home, that could ruin your chances of her getting the visa. It's extremely hard to be apart for so long, especially when she is pregnant, but it is better to suffer a little bit now than suffer much more later.

01/26/2008: Married.

02/06/2008: U.S. Embassy in Santiago informs me that they are not much for dumb rules and I CAN direct file!

03/06/2008: Applied for Chilean resident visa, which will allow me to direct file.

04/17/2008: Chilean visa approved.

06/04/2008: Applied for husband's visa at U.S. Embassy.

06/13/2008: Final interview date set for July!

07/01/2008: Medical exam.

07/09/2008: Final interview and approval of visa!

no visit/tourist visas possible since we ARE married, a visit is Verboten (that means Forbidden in nazi).

and my wife has great job, home, etc. Doesn't matter.

I think you mean German...

And if you already have a visa that is one story its then up to the Immigration Officer at the POE to let you in or not. Trying to get a tourist visa while applying for a GC is normally denied because of the intent to immigrate.

My wife and son are coming in 2 weeks so I will let you know how it goes. My son is a USC and my wife has had a B tourist visa for more than 15 years (not that means much).

visiting isn't forbidden, but it does seem to be very country specific. Canadians seem to have very little problem, but some countries don't seem to be able to visit ever. Call the consulate in Tokyo and ask.

Thanks for the information - I will make sure to call the consulate.

Actually, I hope the kid is born in Japan so her parents will be there and see it (it is their first grandson) and I took their family name so I am part of her family now so the last thing I would want to do is cause a problem and not have her get her visa.

While she has no ties to Japan...none at all, I am hoping seting up the insurance to pay for the child in Japan and showing an appointment that the insurance has agreed upon to have the child in Japan will be sufficient - we will see.

I will keep everyone posted.

My wife visited the US from China using a B1/B2 visa she had from an employer. US immigration questioned her for 10 minutes at arrival but let her in. She then returned to China within the time limit of the visa. More recently we decided to try it again. The visa is expired now. So she applied for a new one, but was denied. I thought that with a record of 3 US visits without any over-stays, they might renew the visitor visa. But that was not the case. Bummer.

for what's it worth i had a similar question. i called the state department number (202-663-1225) 3 weeks ago and talked to one of their operators, referred to as a 'visa specialist'. i asked if my wife could visit the usa while we are in the immigration visa process. he said if she is a japanese citizen, with a japanese passport traveling under the VWP then yes she can visit. I asked if she should bring proof of ties to japan. he said no, just a return airline ticket.

we have not decided whether to try to visit or not. i'm not sure what to make of it. it seems to go against what i've read about.
