Well first of all a big hi to everyone!

I have a few questions I could use some help with!!! Please!!!

1) I was cautioned not arrested, for a crime of moral turpitude. Stealing. However I was 17, but its been 4 years and not 5, as the petty offence law, usually allows it if its been 5. Anyone have any ideas? if ill be denied.

2) Made a mistake on the ds230, when asked if i was arrested i said yes, but recently found out i wasnt...got the police to write a letter, and sent that to nvc yesterday.

3) Medical, I had some depression a few years back, and got some kinda anti depressants, now do i admit it on the medical questionaire? Or will it cause all hell.

Please help xxxx

In order to be officially cautioned for an offence you first had to have been arrested for it. Could you explain the circumstances I wonder if you mean you just got spoken too without anything officially being done. If you were officially cautioned that counts as a conviction and the USCIS does not recognize the UK concept of spent convictions. A caution for a minor theft probably will not make a difference but there is no guarantee

As to the medical. Your choice but the golden rule is never ever lie about anything to do with immigration. If it gets found out later it is grounds for the visa to be cancelled. Best course of action is get a letter from your GP detailing what you had, how it was treated, the treatment was successful and there has been no relapse for x years and no anticipated likelihood of a relapse. That has been sufficient when others have been in a similar situation in the past.

Is this the same offense as #1? I'm not sure if it will cause a visa denial, but you may expect to have some questioning on this at your visa interview.

If you were treated by a physician, and the medication was prescribed by a doctor, you should state it on the questionaire. Depression, as far as I know, is not a reason for a visa denial. (I could be wrong, and if so, someone will come by and correct me, I'm sure.) What you never want to do is lie on anything related to your immigration. (Well one shouldn't lie, period....but that's neither here or there. :P ) If it should come out, at a later date, that you have misrepresented yourself, it can cause an irrevocable visa denial, and/or ban from getting the visa, and that's not desirable. :)
