Question #15 on the I-765 asks what is my current Status? Am I considered a visitor? I am applying for the AOS, I-130 and EAD and the AP. Not sure what it means about my current status though.

I checked the sample form and it says K1.

Your current status as of the time you are applying for AOS is non-immigrant. You will want to list the visa you came in on as well.

So just to be sure on the EAD which is leaving at the same time as the AOS I would put non-immigrant? As for the visa, I am from Canada and all they did was check my passport and waived me through.

Then put down VWP (Visa Wavier Program). Did you intend to marry and stay when you entered with VWP, or did that come up after you got here?

I am Canadian so I do not belong to the VWP. There was no intention to stay at all, it just happened and I have lots of proof. So now I'm wondering what to put is it still non-immigrant or am I an immigrant? Really not sure what to put since I'm not part of the VWP nor a K1.

Its basically the same thing as VWP, even though they don't call it that. You are non-immigrant unless you came on an immigrant visa, or you have adjusted status.

Thats your status after you have applied for AOS. However, on your application they want to know your status at entry, ie VWP, K1, etc

Thats your status after you have applied for AOS. However, on your application they want to know your status at entry, ie VWP, K1, etc

My status at entry was as a visitor and that is question #14. Its question #15 Current Immigration Status that I'm concerned about.

My status at entry was as a visitor and that is question #14. Its question #15 Current Immigration Status that I'm concerned about.

You are still a visitor until you send in your package. In most cases your status will be the same between those two questions.
