• Can I reside and work in the US with an Immigrant Visa if I’m denied a Green Card? If I’m denied a Green Card will my Immigrant Visa be revoked? Does an Immigramt Visa require renewel and if yes, how often?

you need to provide more info in order to get advice from us, what kind of visa do u have? tourist visa does not authorize you to work in usa

u need to give us a background of your status

I don't have an Immigrant Visa as of yet, I'm simply preparing myself. What type of Immigrant Visas are there?

Is your purpose "to visit" or is your purpose "to work?"

My purpose is to immigrate and live with my husband, although I would enjoy being able to work if I'm only allowed to visit. I enjoy working and would like to work during my visits if visiting is my only option.

I suggest that you and your husband :guides:

They will explain how he can petition for you to come to the States as his spouse, and the end result for you will be an immigrant visa. When that visa is activated at a POE, you will get a green card that allows you to reside and work in the States.

if your husband is an american citizen and living in the usa and thats why u want to live here then he should get you a k-3 visa which is the one for spouse i dont know much about it but there is a forum specific for that, one you get your visa and live here with him then u can apply for adjusment of status ok and yes you will be authorized to work once you apply for your permision to work EAD or if you wait till you are granted your green card at the end of adjustment of status you can work

get into the k3 forum and search for more info there ok

An Immigrant Visa gives you Permanent Resident status when you enter the US. A Green Card is simply proof that you are a Permanent Resident (it's actually called a Permanent Resident Card).

Permanent Resident status gives you permission to live and work indefinately in the US. It also allows you to travel without additional permits.

If you have a genuine marriage you don't need to worry about them denying you a greencard... but before you can get one you have to have a visa to get into the US.

Karen - Melbourne, Australia/John - Florida, USA

- Proposal (20 August 2000) to marriage (19 December 2004) - 4 years, 3 months, 25 days (1,578 days)

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

If you have a genuine marriage you don't need to worry about them denying you a greencard... but before you can get one you have to have a visa to get into the US.

The reason I'm worrying about them denying me a greencard is because of this:

This is my case:

In accordance with the provisions of section 212(a)(9) of the Immigration and Nationality Act (Act), you are prohibited from entering, attempting to enter, or being in the United States:

At any time because you have been found inadmissible or excludable under section 212 of the Act, or deportable under section 241 or 237 of the Act, and ordered deported or removed from the United States, and you have been convicted or a crime designated as an aggravated felony.

AND

That was a little over a year ago, my then-boyfriend who’s a USC came to my country after I got deported and married me 10 months ago.

Does having a genuine marriage still apply in this case when it comes to obtaining my Green Card?
