I did a little investigating. And, yes, I think he has to either file through the DR or be eligible for residency in JA to file in JA.

I think you are going to get kicked back to the DR.

Yep that is the same thing I found. Unless he files and becomes a resident of JA (which I don't think he will be eligible for based on a work visa) he will have to process through DR - his home country. DR does process their own stuff...they are notoriously hard to get through and it can take upwards of 2+ years for an interview...check the embassy info above on this site or the embassy site...

Maybe try calling around to USCIS and NVC and explain the situation and ask them if they can tell you where your petition will be sent. It doesn't matter what address you put on the petition...it all comes down to which country has jurisdiction and it would be the country in which he is a resident/citizen.

Hubbies mom did something similar...she wanted a visitors visa to come to the US. She tried through JA and was denied. She moved to the Bahamas to work and stayed for 4+ years and became a legal resident there and then applied for a visa to the US through the Bahamas. The key being she was a legal resident of the Bahamas therefore they had legal jurisdiction over the visitor visa petition.

Dosen't the Ja embassy cover the DR? I thought I say it somewhere. Correct me if I am wrong, but I'm gonna check it out.

From what I could find (which was limited), the DR has it's own embassy in Santa Domingo.

Actually with a work visa, you can apply for residency quick in JA, I was gonna do it. Its supposedly faster to get when you are actually contributing to the economy...ie have a job, or a business. I just kno residency is realtively easy to get in JA. A friend moved there from Germany for her JA husband and they applied for her residency at the Embassy and got it in a day!

So, applying for JA residency is a moot point now.

Well what do I do now? I have spent all afternoon basically freaking out and now my fiance is upset and says that Immigration is joke..blah blah blah!

I called NVC, they said that since he is living there, he should be able to have the interview there but they have no way of really knowing until they receive my file.

I also called my Senator from GA and faxed him a letter asking him to inquire about this situation and ask if we can interview in Jamaica. His immigration assistant called me and told me they received the fax and would contact the embassy tomorrow.

Anything else? Should I do anything else?

Gosh...I am so nervous. We really were hoping for an interview before his permit expires in July!! How long does Jamaica usually take to schedule an interview? How about if I have a Senator pushing it (like I do), will that help with scheduling the interview faster?

To apply for residency you have to have lived there for 4 years. He has only been there for 1.5. How were you going to apply for residency? I am confused!

Yes, true we have our own Embassy here in Santo Domingo with a very long waiting list.

You can request an interview at another embassy. Shouldn`t be a problem for him.

Your congressman's office can check on things and clarify for you. I've not heard any stories of any really helping move things along faster. There are so many checks to clear and hoops to jump through to get a visa. The process always seems to be the same......only longer if there are issues.
