I arrived in the US on an i-129f visa which was filled concurrently with the K3. Shortly after I arrived I got notice that the K3 had been approved.I contacted my local immigration office who said I could choose which avenue to pursue to get the green card. The process of AOS looked to take longer, so I waited for my Interview date and would fly back to London to complete the process. It took longer than anticipated and I had to cancel due to the effects of the hurricane when I got the date through. My main question is whether the green card interview can be rescheduled to take place at my local office here in the US, due to the unforeseen circumstances that have hit this area.

dave, you need to provide more specific information.

Where are you?

On what status?

Have you paid fees to the NVC?

Have you filed I-485?

If you want to interview in the US, you must not pay fees to the NVC for DS-230, I-864 and you must file form I-485 instead.

Tell us more accurately what you have already done and what correspondance you've rc'd from USCIS, NVC or London.

Dave,

Your post is really confusing.

- I-129F is a petition, not a visa.

- K3 is a visa, the application for it cannot be filed concurrently with the I-129f petition. The K3 visa application cannot be filed until after the I-129f petition has been approved.

- If your K3 visa application was not approved until after you arrived in the US, what visa did you use to come to the USA?

I believe what he is saying is that he arrived on a K-3 visa, but his I-130 was also approved, so he proceeded with the process to get the CR-1 visa overseas. However, due to the effects of the Hurricane, he was unable to go back to England for his CR-1 visa interview.

Therefore his questions is, can he reschedule his CR-1 visa interview and have it at his local INS office, or does he have to go back to England and have it at the consulate.

While I understand his question, I do not have an answer.

Hi,

Yes,I'm sorry if I mixed up some of the terminology for the visas and petitions, but Gatorfan has it correct. My I-130 was approved shortly after my arrival in the US from the UK.After speaking with immigration in the US,AOS in the US region I am in, New Orleans was going to be a very lengthy process even before Hurricane Katrina. I had to cancel my interview in London for my green card because of the hurricane and have not been able to reschedule. Due to the changing circumstances and the fact that my 2 year visa is due to expire, I wanted to know what options I had.

Have you tried to reschedule London? Frankly, based on what you've said here, I would think it's easier, cheaper and faster to go to London and get your IV. If you just now file for AOS, you will need AP in addition to renewing EADs and for who knows how long. AOS has not gotten any faster in NO since Katrina :(

As to the K-3 expiration, you could search for posts from cindyabs. She faced a similar problem & had info on extending the K-3 status (if you stay to AOS) and/or getting to London 'in time'.

London should still have your file, and be able to schedule you in. Emailing them has been successful for many people, esp if you have a London case number. How long has it been since your first scheduled interview and how did you leave it with them?

Thank you meauxna. I will check on the postings that you have pointed out regarding an extension. I am thinking that London will be the easiest option too, but just wanted to see if it could at all be transferred due to circumstances, as I had not planned on going back just yet. The consulate understood my reasons for cancellation, and my details should stiill be active. I will just have to find out what sort of timeframe they can fit me in now if that is the way to go.
