MY HUSBAND HASN'T FILED TAXES

Timeline

I got married in November last year, and filed the AOS in December.

In the package was of course the I-864 Affidavit of Support with my stepmom (who's a US citizen) as a joint sponsor, but we forgot to fill out one from my husband who's the petitioner and enclose that too.

Now I got a RFE asking for a I-864 from my husband and of course he's gonna have to enclose a Federal Tax Return for the most recent year.

Now the thing is that, my husband hasn't paid taxes since the year of 2004,since he's been unemployed for a while and since the end of 2006 he has had a job that pays him "under the table". He makes a good amount but in his selfishness he hasn't filed taxes.

His annual income is below the poverty guideline, that's why we're using my stepmother as a joint sponsor.

I am just really uncertain of what to do. Do I just send back the form from him with no tax return, or is he going to have to file taxes for 2006???

I'm sorry if it all sounds confusing, please feel free to ask me further questions if something is unclear, I just really need help since I don't know anything about taxes in this country.

OUR JOURNEY SO FAR

December 2005 - Met for the first time at a christmas party

Year of 2006 - I'm traveling back and forth several times to visit

October-December 2006 - I stay in New York for 3 months on tourist visa

February 2007 - Brandon flies out to Denmark to visit and meet my family

March-June 2007 - I stay in New York for 3 months on tourist visa

October 2007 - I go to New York to stay for another 3 months.......but on

November 10th 2007 - Brandon asks me to marry him!!! ENGAGED!!!!

November 21st 2007 - MARRIED!!!!!!

December 26th 2007 - Sent off I-130 and AOS package

January 7th 2008 - NOA's received

January 14th 2008 - Biometrics letter received

January 19th 2008 - RFE received, on form I-864

January 25th 2008 - Biometrics appointment

February 13th 2008 - RFE sent back

March 14th 2008 - EAD Card production ordered

March 15th 2008 - EAD card received

March 17th 2008 - SSN ordered

March 26th 2008 - SSN received

March 29th 2008 - INTERVIEW LETTER RECEIVED

May 6th 2008 - INTERVIEW - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Regardless of how he is making money, he still has to pay taxes on it.

He will need to file taxes in order to provide you with the I-864 form.

Get ready to file and pay those back taxes.

The primary sponsor for an adjustee in a marriage based case must be their spouse. And a sponsor must produce an affidavit with the most recent tax return attached or the affidavit will be rejected.

This fact isn't obviated if you have a joint sponsor. Their sponsorship cannot stand alone without your husbands.

Actually, now he told me that he didn't work at all in the year of 2006 which is the most recent tax year. Should I just enclose a written statement saying that???

And maybe try to get tax returns from 2005 and 2004 where he did have a steady and official job...??

The most recent tax year is 2007. But since you have already filed, you may not be required to show it.

He will need to file for the years he made above the minimum, even if he was paid "under the table". Not paying or reporting taxes can have other consequences if it catches up with him.

The most recent tax year is 2007. But since you have already filed, you may not be required to show it.

If one's income is below the minimum required to file a return, "under the table" is the payor's IRS issue, not the payee's. Unless you know the amount of earnings, you don't know there are any consequences for the OP's husband.
