I have a problem I need some advice.

My grandmother has been diagnosed with some sort of viral heart disease and my Mum says she may only have a few days left. I really NEED to get home before she passes away. I submitted my I-131 on Friday by efile and faxed UCIS a request to expedite it.

I just got off the phone with a really patronising woman from UCIS (I have gotten her a few times, but everyone else seems lovely!) and she basically said (and she sounded like she was reading from a manual) that I should not leave until I recieve the advanced parole. But I have to leave BY WEDNESDAY AT THE LASTEST. She would not give me any advice, like getting it sent to the UK or anything. She basically said, "sorry, it's a bad situation, but they will not let you back in the US if you don't wait for it before you leave.

Does anyone understand that I have to leave now?! I can beleive that immigration would be so cold hearted as to not let me back in the country because I had to leave right away as my Grandma was dying.

Anyway, long rant over.

Please if anyone has any experience or advice with this type of situation, please please share with me. I am desperate.

Sorry.. but you have two very stark choices..

You can 1) Leave the US without AP and then have to do the process all over again with the K3..

or 2) You can try to go tyo your district office and make an application for an Emergency AP. It basically will require that you get evidence of the emergency and a lot of throwing yourself at their mercy...

Those are your choices... If I were you I'd get a letter from your grandmother's doctor faxed to you and then go to your DO stat...

IF you are denied the Emergency AP, you have to make a decision on whether the possibility of a few minutes with your grandmother (she may die before you even get there) is worth 6 months plus of being away from your spouse... A hard choice and one that should be made rationally... something that is difficult in these sort of situations...

This a good example of why everyone should apply for AP at the same time as AOS... you never know when you may need it...

Sorry to hear about your grandmother.

I had to return to Canada before my AP was approved because my Mom was ill in the hospital. I got a letter faxed to me by my Mom's doctor, made an Infopass appointment at my local office, and was approved the same day.

You have to have a letter explaining your grandmother's condition from a doctor or else you will be denied.

You probably will not be able to get an InfoPass appointment by Wednesday, so you should just go down to your local office today (with your letter from the doctor) and see if they will let you in due to it being an emergency.

Thanks for your advice guys....not the news I wanted to hear, but I at least I know my options!

A couple more questions:

Does it have to be a fax from the doctor, can it be an email?

Do they need to know details of her condition, diagnosis etc. and how serious it is?I want to make sure I have all the info before I get in touch with them.

Secondly, is the only way to get it in one day to go to your local office? Becuase one person from UCIS siad I could do it by faxing to this particular number and then just send off my supporting documents.

Lastly and most important! Can I leave the US and then when the expedited I131 come through to my address, get my MIL or someone to send it to me in the UK. i.e do immigration know I have left the country and it will only be 'flagged' when I return?

Has to be a fax on the doctor's letterhead.. What's to stop anyone from writing that email.. It has to detail her condition, and her estimated time that she will be living... Anything that can be written to show the true nature of the emergency..

Yes.. the only way to get in it in one day is to go to the local DO..

No.. the reason for the word "Advanced" is that it has to be approved before you go... if you leave before the AP is approved, you will have abandoned your AOS application...

Without any supporting documents (I can't get hold of the doctor) is there any chance they will approve me in a day?

If she is in a hospital or hospice, then a letter from any medical personnel there would probably do, I don't think it needs to be her specific doctor. When I asked about emergency AP at Phoenix - they kept repeating that they needed documentation of the prognosis. Another thing I wanted to let you know is that I was told I would be required to repay the 170 dollars and the local office only issues single entry APs.......this seems to be pretty variable, I know other people have been told the same thing, but others did not have to repay. So, I guess you should be prepared to pay again tomorrow, just in case........GOOD LUCK!!
