Section 221(g) which prohibts the issuance of a visa to anyone whose application does not comply with the provision of the immigration and nationality act or regulation issued pursuant thereto.

Your case has been returned for review to the approving immigraion office via the National vsa center you will be contacted and may follow up directly with that office for further information

It that is all it says and there are no instructions for you to provide anything or no mention of administrative review, then it is a Notice of Intent to Deny. The petition will be sent back to the service center in the US, where they will most likely just let the approval expire.

If it says more, please either provide all the text or scan and attach the document to a post. Actually scan a copy and black out any personal identifying information.

Some of these notices can be overcome with the intervention of a local attorney familiar with the Consulate. That is the course of action I would recomment.

Surely, you have some clue as to the reason. Usually, they don't believe the relationship is bona fide. So, why do you think this happened?

that is the paper that they gave me :

That's a straigh Notice of Intent to Deny. As I see it, you have two choices.

1. Get a local lawyer to attempt to intervene immediately.

2. Kiss the visa goodbye.

You must have some clue as to the reason for this, based on the interview. What do you think?

the interview was ok and i answered all questions .......

Obviously, something was amiss with your case. It would be extremely rare for the applicant to be unaware.

If you would like to provide as many details about the interview including but not limited to the questions and answers, perhaps we can help you. Either way. The two choices are all I see for you at this point.

i think the age difference (29 yrs) was the problem that made the officer doubt in the relationship despite my wife had changed her surname to mine.

all the needed documents were provided at the interview

Edited by One heart

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

Obtaining a visa is about a lot more than "needed documents". That your wife is 29 years older would be a huge obstacle to overcome. I see an old post indicating she planned to attend the interview with you. Whether she did or didn't, the CO was evidently not convinced the relationship was bona fide.

Same two options already mentioned are all the thoughts I have.

you have been DENIED a visa and the CO has sent your case back to USCIS to have it REVOKED due to the validity of the relationshsip. it is a pretty standard way that most couples are denied. you get no chance to provide more proof. you get no chance to even find out WHY.

have you read the pinned post in MENA about 221g returned petitions? if not go there and read it. the first few pages hasnt much info but eventually you will get to the info area.

have your wife e mailed--called the consulate asking to speak to the consular chief? does she have her reps on board so they can make an inquiry on her behalf?

one heart there is much to do. please send me a PM.

just one clarification. your profile says country: jordan, and your timeline says consulate: sydney, australia

I think several things need clarifed: Early in your posts, your wife said she was a US Citizen married to an Australian Citizen. Then she said you had a 2nd wife in Canada. Then there was some discussion about dependants, ie a child being a partial dependant. Then your posts said you were married in Jordan and your interview would be in Jordan.

If you are married to a Canadian Citizen and applying for a visa with Canada also, then it is quite clear this is Visa Fraud. I hope that is why your Visa was denied.

did you file as an Australian or Jordanian? did your wife expain this dual citizenship when she filed?

is your wife married to someone else? how did this subject come about?

one heart---sometimes one needs to know more of the situation before help can be offered. when the whole story is not given then the help offered most likely is not valid.

Yes One Heart if you truly want the help its here but everything must be included or you will be advised incorrectly, please clarify all this talk about other marriages etc. Im thinking if in someway there is other marriage then you are aware of the denial situation. You would have included the divorce papers from past marriages to file in the first place from either of you....
