My alian husband applied for a social security card a couple of weeks ago. My question is... He has to apply to work? or can he just get a job with the card? I thought once you have a ss card you can work now i read you have to aply to work and pay a fee. Thanks

If your husband got an employment authorization stamp on his I-94 when he entered the U.S., he is authorized to work until his I-94 expires (90 days after entry). Once this expires, he must have an employment authorization document (EAD) in order to work legally. Usually you apply for the EAD at the same time that you file for AOS. It can take up to 90 days to receive the EAD from the time of the application.

Jenn is correct. You need to have EAD to work legally.

His social security card will probably say something about needing DHS authorization before he can work, which is the EAD mentioned by the previous posters. The EAD takes awhile to process, so your husband should think about other options to pass his time, like volunteering.

As others have stated, if at the POE he was given a temporary EAD it is for 90 days from his entry. He can apply for the EAD at the time you file your AOS request. If after 90 days of the receipt of your EAD he hasn't received his biometrics and/or EAD, you can make an info pass and they will grant him the EAD. I know my husband's EAD got stuck as approved in the system and even with the info pass they couldn't give him the EAD but it did arrive within two weeks of our appointment. Of course, after 3 days we had our AOS interview and he was approved and received his green card on 2/13 so now we don't have to worry about any of this. We just need to go to SS office and have the DHS authorization removed. Go to the uscis web site and the instructions are there. Good Luck!
