thanks for the replies, I did meet my fiance in person and mailed in my I129f with lots of evidence in Oct. 2007. I just asked cause Ive read so many bad stories on the lawyers websites or doing web searches on denied I129fs or people denied at the consolate. Most denials were for good reasons but I few seemed unfair.

a lady was going to marry someone from russia or a country near there. When he got to the consolate he was asked why he loved her and he gave a very bad answer like, "cause I do" or something like that and after the interview the interviewer denied him and the lady "petitioner" called crying and the interviewer said she has been doing this for years and knows how to spot someone trying to go to the US for citizenship. She mentioned that he couldnt even say why he loved her.

I read another of someone from asia who was asked if she wanted to go to the US to get a citizenship. She didnt understand what the interviewer was implying so she answered yes. She misunderstood and got denied.

Ive read some of the immigration lawyer websites and they give examples of people who were denied for what looks to be almost no reason but I suspect they are trying to scare people into getting a lawyer. Ive even read that about half of all applicants get rejected which scared me to hear that. My situation is ive never been married before, dont have any criminal record or anything, I met my fiance at filipinaheart and knew her for about 2 months before filing the I129f. For those who have been on this website for a while, I was wondering what you have seen as far as approvals. Do most legit couples get approved or is it true that a lot of people get denied for almost no reason or something very petty?

One of the requirements for this petition is that you must have met your SO in person at least 2 years prior to filing.The USCIS may not like the fact that you've only known her for 2 months.

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

That is not quite the proper wording.....You must have met in person with your fiancee sometime within the past 2 years. You don't have to know each other for 2 years... :wacko:

Yes, it's a common misinterpretation. Technically, you could file the petition the same day you first meet in person.

What you cannot do is marry somebody you never met or someone you last saw in person more than two years ago.

Most of the time its meaning (to me) that at that time in the embassy they are denying the visa (then) but returning the case to calif/vermont for further review and sometimes given the chance to add more evidence. I know mine said for further reivew but expired in calif the same month it was returned (this now seeming to be the norm for them) others (returned) and going thru vermont are just now being touched after 18 months being there. None are given reasons as to the return that i know of maybe the generic (evidence of relationship)

She mentioned that he couldnt even say why he loved her.

This is one thing that some do not understand when it comes to emigrating to the US. The consular official that interiews the visa applicant is charged with, among other things, examining if there is a valid reason to give the applicant the visa he/she is applying for. In the case of a K-1(fiancee) visa, for example, the "valid reason" would be that a viable an current fiancee relationship exists between the petitioner and the foreign fiancee....and that this relationship will lead to fruition and culminate in marriage to satisfy the requirements for the visa. Within this context, the question "Why do you love him, or her?" and the resulting answer, can be quite importan to the consular official in determining if a fiancee visa should be issued to the visa applicant. Frankly, if you love someone, are in a strong relationship and are engaged to be married, you should be able to come up with at least a few reasons as to why.

Before the interview is to begin, the beneficiary is asked if they require the benefits of an interpreter and one is provided if necessary. There is no languare requirement for the K-1 or the spousal visas....so if the beneficiary feels that their english skills are lacking they are encouraged to ask for the interpreter to translate. Denials based upon a "misunderstanding" of the question should not happen...that is why there is someone there to translate if necessary.

sorry to hear that happened to you. any idea as to what there reason was for doing that. Did the interviewer indicate anything at the consulate as to why the denial?

Nope actually he felt interview went good, but we are just one of many going thru casa with this problem, actually he did ask her if she wanted to see the stuff (evidence he had brought and she said a definate no she had enough and handed him the paper. Casa is in another ball game than alot of the embassys we are used to it.

*Those who will be denied have these reasons: :crying:

1. Lack of documents

2. Misrepresentation of facts

3. Medical Concerns

4. Criminal Grounds

5. Lack of Petitionable Relationship

* :(RFE's will be sent only to those applications who failed/forgot to submit necessary documents .

* I believe that as long as you follow the guidelines accordingly, submit all necessary documents, triple check your documents and pay necessary forms. :whistle: ....100% will be approved even without the help of lawyers. Just stay in these site though because VJ FAMILY are more than willing to help based on real experiences. :yes:

* And yes....the MEETING IN PERSON is important....because, up to the final stage of K application....you will be ask to submit EVIDENCE of the RELATIONSHIP (airline tickets,pictures of you together....etc)

I agree.. I just found out that my Fiance now is my 'annoying husband' :lol: received few(3) RFE :whistle: it took 11months and also there was additional policy in IMBRA.

don't worry about it as long you and your fiancee have no Criminal record and other things that causes Denial.

My hubby didn't used a lawyer for Fiancee Visa I-129F and I filed AOS application with my husband assistance..we didn't have any problem.
