I was just wondering if it happens often that the uscis denies applications or do they almost always send RFEs. Ive read some of the immigration lawyer websites and they give examples of people who were denied for what looks to be almost no reason but I suspect they are trying to scare people into getting a lawyer. Ive even read that about half of all applicants get rejected which scared me to hear that. My situation is ive never been married before, dont have any criminal record or anything, I met my fiance at filipinaheart and knew her for about 2 months before filing the I129f. For those who have been on this website for a while, I was wondering what you have seen as far as approvals. Do most legit couples get approved or is it true that a lot of people get denied for almost no reason or something very petty?

You must go see her in person and have pictures and emails to send with your I-129F, proof of a legitimate relationship, and proof of income. A lawyer is really a waste of money, you can do this process yourself. It's really very simple. You either have a true relationship or you don't. Knowing someone for 2 months will not cut it, USCIS won't like it.

7/4/05 - Met

4/16/06 - Went to Visit her in Manila

4/18/06 - Proposed to her at Baloy Beach Resort, Zambales, Subic Bay

4/27/06 - Sent to Nebraska Service Center

5/02/06 - I-129F Filed

10/17/06 - Petition approved in California Service Center and sent to NVC in New Hampshire

12/11/06 - NVC New Hampshire Received Case (FINALLY)!!!!!!

12/12/06 - Called today and got our MNL2006845xxx

12/19/06 - Case Arrive in Manila

02/28/07 - K-1 Packet arrived to my sweety

03/26/07 - CFO Seminar/needs to go back to after interview for sticker

03/29/07 - St Lukes Medical.

04/03/07 - Arrived for second time to be with my sweetheart....

04/11/07 - Interview Date----PASSED with flying colors......St Lukes was a little pain..but we fought em...

05/12/07 - My baby and I got home today POE Seattle Flight home arrived at 11:45AM.

Flight from Manila to Seoul was great, then a 12 hour layover in Seoul, that sucked big time. Flight to Seattle from Seoul was long and the plane was warm too. Once we got to Seattle it was so worth it.

06/08/07 - Got married in Everett WA

07/19/07 - Filed for AOS

10/15/07 - NOA for AOS

12/06/07 - Interview for Green Card approved in Seattle, good for 2 years.

12/18/07 - Green Card in the mail...wooo hoooo...will apply in 2 years for conditions removal.

07/01/08 - We had our first baby..Renae Sofia Reynolds 8 lbs 3oz-C-Section.

If you have a bona fide relationship, you will be approved. The numbers you threw out are false. Most likely as you said, to scare people in to using this particular lawyers services.

Have you met your fiancee in person? From your account that does not seem the case. Meeting in person at least once before you file the I-129F is a requirement of this petition. Without this, there is not much chance your petition will be approved.

ETA: Not sure what information you've been reading, but for the most part the fiancee visa is 'gettable'...but a great deal of patience and fortitude of will is required. :)

It's pretty rare to get a Notice Of Intent To Deny at the petition stage. As other people have mentioned, as long as you have met the requirements (i.e. have met within the last two years, are a US Citizen, and are both free to marry) you will probably be fine.

Lawyers use scare tactics to try and make this process seem bigger and scarier than it really is. That's not saying it isn't big and scary to some extent, but it's more LONG than it is big or scary. A lawyer cannot speed up the process. They're great if you're not comfortable with reading and filling out forms, or if you have complications in your case, but beyond that most people find them pretty useless.

As long as you can read forms, fill things out correctly, and follow instructions (some of which appear to make no sense), you're fine.

1. Lack of documents

2. Misrepresentation of facts

3. Medical Concerns

4. Criminal Grounds

5. Lack of Petitionable Relationship

* I believe that as long as you follow the guidelines accordingly, submit all necessary documents, triple check your documents and pay necessary forms. :whistle: ....100% will be approved even without the help of lawyers. Just stay in these site though because VJ FAMILY are more than willing to help based on real experiences. :yes:

* And yes....the MEETING IN PERSON is important....because, up to the final stage of K application....you will be ask to submit EVIDENCE of the RELATIONSHIP (airline tickets,pictures of you together....etc)

If you have a straight forward case, you do not need a lawyer.

Not meeting the person in real life on the other hand = denial.

You have to have met in person at least once in the last 2 years and be able to prove that by sending copies of boarding passes, stamps in your passport, pictures (which are secondary evicence) with your initial petition.

The having met rule is a primary.

For K1 USCIS has no role in approving applications. The I-129F is a petition. The Department of State through their immigrant visa units at Consulates abroad approve visa "applications". If you've met the paperwork requirements including primary evidence of meeting in person in the last two years, your petition will be approved. If you pay the wrong fee, leave out a document or haven't met in person in the last two years, USCIS will send deny your case.

The vast majority of fiance(e) visa application denials at Consulates are eventually overcome. Most stem from not properly following the instructions given. If you are good with attention to detail, can follow instructions and have the fluent disciplined English language skills of a high school graduate, you can probably do without an attorney. The foreign fiance(e) will usually need assistance with the forms but you can probably provide that assistance.

Not quite true. You DO need to meet and prove that you have met when you file the I-129f or it will be an automatic denial (barring a few circumstances that almost never are accepted). At the final stage of K1, the embassy stage, you are correct in that they will ask for evidence of the relationship. Evidence of meeting in the last 2 years at initial filing, evidence of relationship at the embassy.

Approval of a petiton stateside is not hard to get, as has been explained to you.

Getting a visa at the consulate stage can be quite different. It's at that end of the spectrum where medical issues, criminal past, the bonafides of the relationship and financial evidence are important.

Filing papers is just that - filing papers. If you can follow instructions you can probably do it on your own. If you hate pushing papers, you might be wise to retain an attorney.

We spoke with an immigration attorney before we filed just to run our case by him. He had past credentials with the State Department and had been practicing immigration law for over 15 years, so I was comfortable he knew his stuff. He asked us questions a layperson might not think about and after determining there were no 'devilish details' we had not thought of, he rubber-stamped us as good-to-go without his assistance. And didn't charge us for the consult. Even if you have to pay for a consult it never hurts to get one.
