Ashley...did Tacho get the greencard first and then the Ss card?

Yes he did . He got Green Card in December and SS like the second week in january but we had to go apply for it and the day after we went back and they gave us a paper stating the exact number.

We have not received any notice regarding the waiver. If his documents expire he will need a new medical, current Mexican passport, Income tax report for the last year and pay the interview fee again.

I was hoping we would hear something soon from immigration so i would not have to pay for the fees again but from the way it looks no luck there. I was going to quit my second job but from how things look like i have made arrangement to work 3 nights a week instead so i can put that money aside in order to pay for all the expenses that he will need.

Well I never did hear back from Charity so I guess she made it in!! Hopefully they don't keep them all day. But they probably will. I'll let you guys know as soon as I hear something. Until then, I am insanely busy at work. Which sucks because I don't feel so great today. Oh well, c'est la vie, right??

My husband just got back from SS office and they told him that immigration had not informed them that they can issue him a SS card yet.I am going to party the day everyone on this forum gets their husband's back....till then...I will wait with you.

I talked to Charity's dad and he said she got in. So now we wait.............and continue to wait.... I'll let you guys know as soon as I hear from her.

And I don't know if I told you all this but....I'm going to Mexico!! Feb. 25-March 5. I'll be there for Javier's birthday on the 26th. Just having a problem with the hotel reservations right now. I got them through this online site called reservetravel.com on Saturday and the hotel still knows nothing about them!!

Melissa that is awesome. I wish I had been able to visit tacho when he was down there. It sure makes the time go by easier. We are probally going down in Nov and taking mi cunado mojado back to mexico to be w/ his family. Good!

I have tried calling but cannot get through the phone line sounds weird,kinda like its messed up.But NVC e-mailed me and gave me a CDJ case # and on it had my hubbys name and then right after his name it has...

CR-1.My att.said that the I-130 is already at the consulate.But they want the $450.00(visa fees and finger print fees combined)so that they can begin setting up appointment for the I-130 interview.

To me it sounds like your I-130 petition isn't quite at CDJ yet... it sounds like you are at the beginning of the processing that NVC does for your I-130. This is how I understand the process, others can jump in (please!) to correct me if I'm wrong.

The I-130 is approved at the Service Center and then sent to NVC.

NVC assigns a CDJ case number.

They send out a Agent of Choice document (DS-3032 or something?) if you don't have an attorney. If you do have an attorney, they are automatically your Agent of CHoice.

The agent is then sent the bill for the affadavit of support and visa fees (probably the $450 you're being asked for now). <------This is where it sounds like you are at.

Once you pay this fee, and it is received by NVC, they send out a request for your Affidavit of Support forms.

You fill the Aff. of Support out and send them back in to NVC.

NVC reviews them and approves them

At some point here, they also send out the DS230 and you have to send it back to them too.

Once the sending back and forth has taken place, and NVC has everything (approved I-130 petition fees, aff. of support, and DS-230), then they send the file to CDJ.

I think the real question here are:

1. How long will it take the I-130 to be processed at NVC?

2. How far are you from waiver approval for the I-129F/K3?

If the times are close or the I-130 will be approved at NVC prior to the I129F/K3 waiver being approved, then I'd personally risk losing the $450 and sending it. Otherwise you can go ahead and let the I-130 sit at NVC without paying the $450 and wait for the K3 visa, then adjust status once your husband is able to get into the US (this is what my husband and I did).

The other unknown here is IF the I-130 makes it through NVC process to CDJ before you return for the post-waiver-approval interview, will they issue the greencard instead of the K3 visa? I don't know the answer to this, but I know others who did not need waivers have had success with this. CDJ policy seems to fall in line because they say the I129F petition is no longer valid once the I-130 hits CDJ.

It may be worth your time to jump into the NVC forum and ask how long it is taking for I130s to make it through NVC currently. People there should be able to give you an estimate which will help you figure out the timelines.

10/3 - Mailed I-485 and I-765
10/14 - NOA1 for AOS and I-765.
10/22 - I-485 Biometrics NOA received, appt 11/15
10/27 - Touched on both I-485 and I-765.
10/31 - I-765 Biometrics NOA dated 10/24. Appt on 11/29 at 12PM.
11/15 - Biometrics for I-485 and I-765 done on same day.
11/16 & 27 - Case "touched" on bcis.gov.
12/7 - EAD approval by e-mail. Card is on its way. Thank you Lord!!
12/12 - Received EAD.
1/9/06 - Applied for SSN. Received 1/17
3/30 - Got our AOS Interview notice!! Interview date 5/31
5/31/06 - Permanent residency granted! Passport stamped IR6. God is so faithful!

2/2/16 - Mailed in N-400 paperwork

2/10/16 - Received text that N-400 paperwork was received.

2/16/16 - Text that fingerprint appointment has been scheduled.

3/1/16 - Biometrics interview, Naperville, IL

3/11/16 - E-notice that case is in line for an interview

7/8/16 - Text/site updated that Interview date has been assigned

7/14/16 - Received letter dated 7/11 with interview date on 8/11
8/11/16 - Interview, given paper that said passed test but no decision can be made at this time.

10/18/16 - Received text, status online updated to say oath ceremony has been scheduled!!!!

Ok here's what happened...took them ALL day to get the Visa. Finally around 5:30 they left the Consulate. Then it took them 3 hours to get the Visa activated. This morning, they crossed the border around 4 am and now they are on the plane on the way home!!
