applying for HB1 visa ... possible to bring wife?

hi

i'm an austrian citizen and going to nyc as as soon as i get my HB1 visa. that will be in november or december 2006. my wife is still studying and will be finished with college in July 2007. Is she allowed to apply for a K1 visa altough I'm not an american citizen?

HI, My husband is from Austria! What city are you from? Unfortunately, the K-1 is a visa intended for the US citizen to bring the non-US finance' into the US to get married, so this would not be the route to go in your travels.

hi...i'm from the very western part of austria...near bregenz...

so...if i'm a hb1 visa holder (valid for 3 years) there is no way for my wife to come with me????? that cant be true!

Read up on H-4 visas; she can come with you, but she can not work.

PS: whoever is doing your H-1B for you should do this extra application for you as well.

As meauxna has said....it *is* possible to bring your wife. However, to answer your original question, that mechanism does *not* involve the k-1 visa...as that is for citizens only to bring foreign fiance(e)s to the U.S. in order to marry them on U.S. soil and subsequently adjust status to legal permanent resident. Since the H1B is considered a "dual-intent" visa, you will be eligible at some point to adjust status to LPR yourself if you choose...and your wife would be able to as well.

Marriage/Child birth before becoming permanent resident

If the spouse or child is in the United States on a valid visa, the individual derivatives may file their Form I-485 adjustment of status applications concurrently with the Form I-485 for the principal applicant or any time before I-485 is approved.

When I first came to the USA 18 years ago, it was on an H1-B visa. My wife at that time came with me, as did my 10 month old daughter.

The company that you are coming to work for should be taking care of those arrangements for you. If they aren't, then maybe you need to reconsider. The consequence of not having her included in your H1-B is that you'll be apart for a while, because, as has been stated, you aren't eligible to petition to bring your wife here while you are here on an H1-B.
