NEED ADVISE K1 or K3

Hi, My name is Jill and my Fiance is living in Brazil at present.

I have been reading all of your postings and read the notice that came out from the USCIS

yesterday. It is very discouraging as we have not even filed yet (I am waiting for my final

divorce decree) We anticipate filing in late February or Early March.

MY QUESTION is this- We can either file the K1 in March or we can get Married in April and then

file for the K3

We plan on getting married- but we are not sure which route to go. Previously, it was my understanding that the K1 was quicker than the K3. But after reading yesterdays postings I am not so sure.

Our ultimate goal is to be together- and the quicker the better. Can you tell me- If you were me and

you were filing next month- Which way would you go?? K1 or K3 (as far as the quickest way)

Thanks in advance for your help and Im sure you will be seeing me around here a lot in the near future.

10/21/08........INTERVIEW IN RIO DE JANEIRO

11/08/08........WEDDING

AOS

12/27/08........AOS SENT

1/2009...........AOS Returned (wrong version of the form)

1/10/09..........AOS RE-Sent

3/11/09..........AOS RFE (income info)

4/10/09..........AOS RFE sent back with info

5/15/09..........AOS transferred to California

7/29/09..........AOS Approval notice sent (NO INTERVIEW!!!)

8/1/09............GREENCARD in HAND!!

Timeline

K-1 is typically quicker if for no other reason if you are ready you can file the petition TODAY.... and not wait for a wedding to occur.

K1 is better and faster way than spousal u need to get married before 90 days and be sure to passed ur papers within 90 days so that ur husband will not be send home and have a bad record here in US. ^_^

Neither is a sure thing. Since it sounds like you're open to both options, why not just pick the one that fits your life plan and priorities best.

Facts are cheap...knowing how to use them is precious...
