Howdy everyone. Im am so bored at work today.

But I have good news I am sending back the RFE today and hopefully will have AOS approval in the next couple of weeks :D.

They requested an original copy of his birth certificate, they said the Affidavit of Age was not good enough. :bonk: HUH... my first thought was are they serious. An affidavit was good enough to get a passprt and good enough for the embassy....HUH :bonk:

I can be a hot mess when need be :diablo: , you know really show my azz :girlwerewolf2xn: ; so, I am sending a little history on the conditions during the Biafra War, and documented information on the conditions of the government hospitals and the way in which paperwork was NOT DONE :no: at the time. I am also enclosing copies of my SO's passports from 12 years of age to current, a copy of Nigerian driving license, national id card, the same affidavit of age, copies of visas from 3 European countries, documents listing the criteria for a Nigerian passport (i.e. affidavit of age), :reading: 40 pages of history and a 2 page cover letter stating how all of these items should be acceptable in conjunction with the affidavit to verify age :dancing: .

Now what!!! :pop: I'm ready..... CSC make your move :protest:

Whew!!!! now that I have that out of my system :ot2:

The RFE

As evidence you submitted a photocopy of a statutory declaration of age attesting to your bith and parentage, which indicated that the applicant's birth was not registered. However, at this time, this document is not sufficient for immigration purposes.

Demonstrating that a record is not available. Where a record does not exist, the applicant or petitioner must submit an original writen statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whetehr similiar records for the time and place are available.....An applicant or petetioner who has not been able to aquire the neccessary document or statement from the relevant foreign authority may submit evidence that repeated good faith attempts were made to obtain the required document or statement. Howerver, where the Service finds that such document or statements are generally available. it may require that the applicant or petitioner submit the required document.

As such, the applicant MUST submit a certificate of non-availability from the civil authorities of the applicant's birth place. "

I think there on "crack, shooting or smoking something" the letter negates itself (the options contradict). So I called them; and I was even advised to send in the same identical document to reiterate its validity and to highlight the govenment stamp and seal. It was also suggested that I locate info from the internet to back up my documents... HUH...

They have already fast tracked my application to CSC (no interview required) now this #######. I'm just going to assume the person is new and give them a boat load of paper-work to look at. They are just smelling themselves, and I refuse to worry about it.

Dang, girl, fight for your man's AOS! After you kill them with that evidence they better not say it isn't sufficient. Good job on all the supporting evidence.

You seem very prepared and I think there won't be any further problem.

yeah, you would think the documents to clear the embassy would be sufficient for AOS.....

and removing of conditions.....and citizenship ....geez :rolleyes:

I feel you on giving history lessons, had to do that at the embassy level.

We got the same RFE on our AOS, needed original birth certificate....we also used Affidavit of Age...anyway we jumped through thier hoops and they were happy,(his sister back home went and got the BC for us at the place they designated and mailed it to us) once we were at the interview, they tried another curve ball with the fact that he did not have his chicken pox vaccine so we went to one of thier MDs ( he was like 100 years old LOL) who was close by, paid the $105 got the vaccine and went back for our approval!!! They just llike to freak us out !!! You will be fine :thumbs:
