Hello everyone! Hope everyone is doing well :)

Okay lets make this the question of the day, meaning, most replies and everyone who posts a reply gets a brownie, freshly cooked!

I married my wife (US citizen) in Nov 2005, filed my paperwork (AOS, etc.) in Nov 2006, and well a year and 3 months after filing I'm still waiting on a reply, meaning case is still pending. I just applied for my second EAD too. So, the question here is that since it has been over 2 years since I married my wife (US citizen), when I do get my GC (hopefully soon, fingers crossed), will it be a temp GC for 2 years or an unconditional GC for 10 years? I've heard if your case is pending and you've been married for over 2 years, that you automatically should get a 10 year one without any conditions attached?

YES :yes: USCIS will automatically issue un-conditional 10 year card if they approve the AOS petition after 2 years of marriage.

So im not so sure about that my wife today recieved her card and it expires jan 2010 and we were married Aug 05 did USCIS make a mistake and if they did how do we fix it to a 10 yr card.

Info-Pass, bring copy of marriage cert and the Welcome letter for the green-card, show that green-card was approved after second wedding anniversary, and then see what they will do for you.

They may tell you to return the card to USCIS using form I-90 and explain the error, attach copy of marriage cert and copy of AOS approval notice along with a letter explaining that you have been married more than 2 years when LPR status was approved.

If your card was issued with incorrect data due to USCIS administrative error, you must mail a new I-90 application using Application Reason "d" My card was issued with incorrect information because of a USCIS administrative error, and any supporting documentation, to the USCIS Service Center/National Benefits Center(NBC) that processed the application/form from which the incorrect card was created. Check the envelope that your I-551 permanent resident card came in to find the mailing address of the Service Center/NBC that mailed you the card. The Service Center/NBC address can also be found on the I-797 "Notice of Action" issued for the application from which the incorrect card was created. In addition to the new I-90 application, applicants are required to send the original I-551 card containing incorrect information, plus the supporting documentation for the requested correction. A replacement application based on a USCIS administrative error must also include an explanation.

There is no fee required. Total filing fee - $0.
