L1 Visa to CR-1

Hi there,

I am now in the US on an L-1 visa and am marrying a USC in March, shortly after that I will be travelling abroad for honeymoon.

So I have two questions.

1) I will only file for adjustment of status when I return to the US. Will I have a problem travelling, or is the L-1 Visa ok to return on?

2) Once I do file, am I correct that I will file for adjustment to CR-1?

1) You may have problem, they will see that the marriage occurred before re-entry on the L-1, and may consider this mis-use of the L-1, use of a non-immigrant visa with intent to immigrate, you would need to demonstrate that immigrations is not your intent when using the L-1 visa.

2) File I-130 to petition for the CR-1 visa and interview for the Visa at the US Consulate in your home country

Is the L-1 not a bonafide dual-intent visa?

Yes it is, I did some looking, and the L-1 should not have problems re entering the USA because it has immigrations intent as an option.
