Timeline

Hello,

We are at the second stage of our DCF and have received packet 3. I have been living abroad for 3 years and recently married my wife in Bangkok in September. I filed for taxes for 2006 but made very little US income. My mom is sponsoring us and has income well above the poverty line. I was told that I have to fill out I-864 and my mother the I-864a. Now I am reading that we both have to fill out an I-864. My question is...which paper does my mom have to fill out, because mine will be pretty blank. Niether me or my mom have W2's as we are both self employed. Is there a service that can help us fill these papers out? Thank you

As you are doing DCF, I would imagine you are living in Bangkok with your wife. If that is, then you are not part of your mom's household and both of you should fill out a I-864. If you have already moved back to the US and are currently living with your mom, you would do a I-864 and your mom would do a I-864a. If her income is sufficient, the form is actually pretty easy as you just skip the parts about assets. :)

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Thank you for your response. Yes i am currently in Bangkok with my wife , but my permanent mailing address is in Los Angeles. My mother and I own a house together. So which am I to do? So much conflicting information. I hold residence in LA and am renting in BKK. I am sure if I go to the embassy here they will further confuse me :). All information is greatly appreciated.

You can't reallly have it both ways. DCF requires you to be a resident of the country in which you are filing - Thailand, in this case. Therefore, you can NOT also be a resident of the USA. so, if you are doing DCF and meet the residence requirements for thailand that are required for you to be able to file DCF, then you would fill out an I-864 and your mother would also fill out her own I-864. No I-854a's would apply in your case.
