Hey...what do you mean by having a proof of no intend? How do u prove that?

You prove that by showing that you didnt move to the US when you entered on VWP. Like selling your house, terminating your lease, or leaving your job.

Asking the question on here could be construed as showing that they have considered it and, by doing so, have intent to defraud and skirt around proper immigration channels. Think about it...;)

Not necessarily :innocent: ... it may mean that they are already in this situation (non-USC here, no intention when initially entered the country and now decided to get married here), but they do not want to make any mistake and just want to choose the best option.

K-1 petition

February 6th 2007 - K1 petition sent to TSC

February 22nd 2007 - NOA1 received by mail!

May 16th - received NOA2 hardcopy

May 25th - first set of documents received home in Bucharest (list of documents to present at the interview) - based on fiance's request to open a provisional file

May 30th - packet arrived at the Embassy, Embassy notifies us about it.

June 21st - interview APPROVED!

June 22nd - VISA

August 17th - arriving in USA, through JFK

Sept 8th - wedding :)

Jan. 08th 2008 - Biometrics

Jan 09th 2008 - Transferred to CSC

Jan 09th 2008 - AP approved, EAD card production ordered

Jan 19th 2008 - EAD in mail!!!

But we don't know that, the OP's question doesn't give any facts either way. :D But yes, if they are already here (and intent at POE was not to stay) then it is fine, if they aren't then it could be classed as visa fraud.
