You prove that by showing that you didnt move to the US when you entered on VWP. Like selling your house, terminating your lease, or leaving your job.

Asking the question on here could be construed as showing that they have considered it and, by doing so, have intent to defraud and skirt around proper immigration channels. Think about it...

Not necessarily ... it may mean that they are already in this situation (non-USC here, no intention when initially entered the country and now decided to get married here), but they do not want to make any mistake and just want to choose the best option.

But we don't know that, the OP's question doesn't give any facts either way. But yes, if they are already here (and intent at POE was not to stay) then it is fine, if they aren't then it could be classed as visa fraud.
