I have been dating a girl in Brazil for a year now. She is 24 has one college diploma and is pursueing her Masters degree in Brazil so she is enrolled in school. She has a mortgage on a house in her name and owns a car. She is working but will only be working at her current place for three more weeks. We have talking about her getting a visa to visit the US so she could see my life and what is like here. She went to school in London for two years and did relief work in Mozambique so she has traveled outside Brazil and returned. I am worried about her getting denied a visitor visa to come here. We have talked about getting married in the future when she is done school but that is not until next year. I want her to come this summer.

Does anyone have similiar experiences like this? I was thinking that I could apply for the K1 visa as starting the process before she applys for the B1 and she could use the K1 paperwork as backup to appying for K1? Should this be done or should she just apply for the B1 on her own?

Any help is apprieciated as we are both stressing the situation!

B1. If she's going there to visit you she needs a visitor visa. In the future if and when you decide to get married then she applies for a K1 visa.

There's a chance she will be denied. Specially if she doesn't have any ties to Brazil. But you said she does. She has to show evidence she plans on going back to Brazil and that she can afford the trip to the United States. Like mortgage, Imposto de Renda, college, family, etc.

Another thing, being unemployed will lower her chances of getting a visa. She should apply while she's still employed.

She probably does not qualify for a B-1 as she has no business purpose in the USA... A B-2 would also be a stretch unless she can overcome the presumption of intent to immigrate... If the consulate had knowledge of a petition for a fiance(e) visa was in process at the time of the B-2 application, it would probably kill any and all possibilities....

She needs to be honest, though that may lower her chances of being approved. If you decide to apply for the K1 later on they ask if you've ever been denied a visa to the U.S. If that were the case later on, she shouldn't have a problem, but it could bite her in the a$$ if she is dishonest.

She needs to be honest, though that may lower her chances of being approved. If you decide to apply for the K1 later on they ask if you've ever been denied a visa to the U.S. If that were the case later on, she shouldn't have a problem, but it could bite her in the a$$ if she is dishonest.

Denial of a tourist visa won't affect future visa petitions.

All questions at the consulate should be answered honestly and succinctly.

The only way to know for sure if she'll be denied or not.. is applying for the visa, all you can loose is the $130 fee! IMO, it's worth to give it a try.

My second tourist visa, (this was in 1997 and before I met my fiance) was approved while I was still attending law school, I was a full time student, and my dad was paying for my trip to the U.S., I brought the University I.D. and my dad's bank account papers.

It is not always true that just because she's unemployed she'll be denied, if her family/social/financial situation is good, and she is able to convince them she is not intending to immigrate, she might get the visa. All you can do is try.

That would be close to my recommendation but I would be truthful and more general in my answer to any question about the purpose of her visit. Pleasure, vacation, visiting friends, going to Disneyland etc. are all perfectly acceptable answers if truthful.

Facts are cheap...knowing how to use them is precious...

I thought Brazil was added to the Visa Waiver program(2007) so there is no need for the B1. Am I correct ?

No. Their adjusted visitor visa denial rate is still not below 5%, so they are not yet eligible to be added. They were told they could be added if the adjusted visitor visa denial rate came below 5%.
